BILL NUMBER: S6328 TITLE OF BILL : An act to amend the executive law, in relation to adding the Wyomanock Creek to the definition of inland waterways PURPOSE : To designate the Wyomanock Creek as an Inland Waterway for purposes of the State's Coastal and Inland Waterways program. SUMMARY OF PROVISIONS : The bill amends Subdivision 4 of Section 911 of the executive law by expanding the definition of "inland waterways" to include the Wyomanock Creek. JUSTIFICATION : The Wyomanock Creek originates in the Berkshire Mountains in Massachusetts and crosses the border into Stephentown. The creek then flows south into New Lebanon where it passes behind the New Lebanon Junior Senior High School and other local businesses before entering the Shaker Swamp, an area which is home to many rare species and plants. MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to adding the Wyomanock Creek to the definition of inland waterways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 4 of section 911 of the execu- tive law, as amended by chapter 98 of the laws of 2015, is amended to read as follows: (c) the state's major creeks comprised of the 18 Mile Creek located in Erie county, Bushkill, Cattaraugus, Cincinnati, East Kill, Esopus (including upper and lower branches), Fish (including east and west branches), Gooseberry, Little Sandy, Onondaga, Sandy, Schoharie, South Sandy, Oatka, Tonawanda, West Kill, Scajaquada, Wappinger [and], Wynantskill AND WYOMANOCK; S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11944-01-5
