BILL NUMBER: S6382 TITLE OF BILL : An act to amend the state law, in relation to designating working dogs as the official state dog PURPOSE : To designate working dogs as the Official State Dog of New York and define working dog for this purpose. SUMMARY OF PROVISIONS : Section one amends section 90 of state law to designate the working dog as the official dog of the State of New York. For the purposes of this section, Working Dog is defined. Section two establishes the effective date. JUSTIFICATION : The original intent of Chapter 571 of 2015, which added Section 90 to state law, was to designate a broader definition of Working and Service Dogs as the State's official dog. Currently, the law names only "service dogs" which technically, as defined by agricultural and markets law, is a dog that is trained to perform tasks for the benefit of a person with a disability. MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the state law, in relation to designating working dogs as the official state dog THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 90 of the state law, as added by chapter 571 of the laws of 2015, is amended to read as follows: S 90. State dog. The [service] WORKING dog shall be the official dog of the state. FOR THE PURPOSES OF THIS SECTION, "[Service] WORKING dog" shall [have the same meaning as set forth in section one hundred eight of the agriculture and markets law] MEAN: (A) A GUIDE DOG, A POLICE WORK DOG, A WAR DOG, A HEARING DOG, A SERVICE DOG, A WORKING SEARCH DOG, A THERAPY DOG, OR A DETECTION DOG AS THOSE TERMS ARE DEFINED BY SECTION ONE HUNDRED EIGHT OF THE AGRICULTURE AND MARKETS LAW OR ANY DOG THAT HAS MET SUCH DEFINITION DURING ITS LIFE; OR (B) ANY DOG THAT IS TRAINED TO HERD AND/OR PROTECT LIVESTOCK OR CONTROL BIRD AND/OR WILDLIFE POPU- LATIONS AND IS ACTUALLY OR HAS BEEN USED FOR SUCH PURPOSES.
