BILL NUMBER: S6701 TITLE OF BILL : An act to amend the arts and cultural affairs law, in relation to child performers in community theater PURPOSE : To exempt community theaters from the laws regarding the participation of minors in a theatrical event SUMMARY OF PROVISIONS : Section one of this bill amends Arts and Cultural Affairs Law section 35.01(2) to add community theaters to the list of exemptions from the laws regarding the employment, use, or exhibition of minors for the purpose of singing, dancing, modeling, playing a musical instrument or appearing in a play, movie or television show. GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the arts and cultural affairs law, in relation to child performers in community theater THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 35.01 of the arts and cultural affairs law, as amended by chapter 35 of the laws of 2004, is amended to read as follows: 2. The provisions of subdivision one of this section shall not apply to the participation or employment, use or exhibition of any child in a church, COMMUNITY THEATER, academy or school, including a dancing or dramatic school, as part of the regular services or activities thereof respectively; or in the annual graduation exercises of any such academy or school; or in a private home; or in any place where such performance is under the direction, control or supervision of a department of educa- tion; or in the performance of radio or television programs in cases where the child or children broadcasting do so from a school, church, academy, museum, library or other religious, civic or educational insti- tution, or for not more than two hours a week from the studios of a regularly licensed broadcasting company, where the performance of the child or children is of a nonprofessional character and occurs during hours when attendance for instruction is not required in accordance with the education law.
