Relates to duties of the office of parks, recreation and historic preservation; states that the office shall have no duty to guard, warn, supervise or otherwise keep safe for swimming, diving, bathing or wading by the public those areas of waterbodies which are not expressly designated by the office for such purposes or are used by the public outside the hours and seasonal times as authorized by the office.

BILL NUMBER: S7193 TITLE OF BILL : An act to amend the parks, recreation and historic preservation law, in relation to the duties of the office PURPOSE OF THE BILL : To expand the availability of swimming within parks under the jurisdiction of the Office of Parks, Recreation and Historic Preservation (OPRHP) by limiting OPRHP's legal duty with regard to persons who choose to swim at unguarded areas within state parks. SUMMARY OF PROVISIONS : The bill would amend section 3.09 of the Parks, Recreation and Historic Preservation Law by adding a new subdivision 23 to limit the agency's liability when patrons swim in areas not designated for swimming or where lifeguards are not on duty. Section 2 of the bill would make it effective immediately. JUSTIFICATION : OPRHP operates approximately 75 designated swimming beaches on lakes, ponds, and ocean shorelines in state parks across New York and provides trained lifeguards, safety equipment and other generally

FUNKE -- (at request of the Office of Parks, Recre- ation and Historic Preservation) -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to the duties of the office THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3.09 of the parks, recreation and historic preser- vation law is amended by adding a new subdivision 23 to read as follows: S 23. NOTWITHSTANDING ANY PROVISION OF LAW, RULE OR REGULATION TO THE CONTRARY, HAVE NO DUTY TO GUARD, WARN, SUPERVISE OR OTHERWISE KEEP SAFE FOR SWIMMING, DIVING, BATHING OR WADING BY THE PUBLIC THOSE AREAS OF WATERBODIES WHICH ARE NOT EXPRESSLY DESIGNATED BY THE OFFICE FOR SUCH PURPOSES OR WHICH ARE DESIGNATED FOR SWIMMING, DIVING, BATHING OR WADING, BUT WHICH ARE USED BY THE PUBLIC FOR SUCH PURPOSES OUTSIDE THE HOURS AND SEASONAL TIMES AS EXPRESSLY AUTHORIZED BY THE OFFICE.
