AN ACT to amend the town law and the public officers law, in relation to
  authorizing the town building inspector, town comptroller,  accounting
  officer  and  clerk  of  the works of the town of LaGrange in Dutchess
  County to be nonresidents  of  the  town  of  LaGrange  under  certain
  circumstances

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 23 of the town law  is  amended  by  adding  a  new
subdivision 30 to read as follows:
  30. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION,
IN  THE  TOWN  OF  LAGRANGE, DUTCHESS COUNTY, THE PERSONS PERFORMING THE
FUNCTION OF TOWN BUILDING INSPECTOR, COMPTROLLER, ACCOUNTING OFFICER AND
CLERK OF THE WORKS NEED NOT BE ELECTORS OF SUCH TOWN. PROVIDED, HOWEVER,
THE PERSON PERFORMING THE FUNCTIONS OF TOWN JUSTICE IN  ANY  OTHER  TOWN
SHALL BE AN ELECTOR OF SUCH TOWN, UNLESS OTHERWISE PROVIDED BY AN ACT OF
THE STATE LEGISLATURE.
  S  2.  Section 3 of the public officers law is amended by adding a new
subdivision 65 to read as follows:
  65. IN THE TOWN OF LAGRANGE, IN THE COUNTY OF DUTCHESS, THE PROVISIONS
OF THIS SECTION REQUIRING A PERSON BE A RESIDENT OF THE POLITICAL SUBDI-
VISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR  SHE  SHALL
BE  CHOSEN,  OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTION IF REQUIRED TO
BE EXERCISED, SHALL NOT PREVENT A PERSON FROM  HOLDING  THE  OFFICES  OF
BUILDING  INSPECTOR,  COMPTROLLER,  ACCOUNTING  OFFICER  OR CLERK OF THE
WORKS OF THE TOWN OF LAGRANGE; PROVIDED THAT SAID PERSONS RESIDES IN THE
COUNTY IN WHICH SUCH TOWN IS LOCATED OR AN ADJOINING COUNTY  WITHIN  THE
STATE OF NEW YORK.
  S 3. This act shall take effect immediately.

AN ACT to amend the town law and the public officers law, in relation to
  waiving the residency requirement for the  building  inspector,  comp-
  troller  and  administrator  of  public works of the town of LaGrange,
  Dutchess county

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  town  of  LaGrange,  in  the county of Dutchess, has
employed individuals that reside outside the  political  subdivision  or
municipal  corporation  as town building inspector, town comptroller and
town administrator of public works in violation  of  section  3  of  the
public officers law and section 23 of the town law. Notwithstanding this
defect,  the employment of such an individual as town of LaGrange build-
ing inspector, town comptroller and town administrator of  public  works
is  hereby validated, legalized, ratified and confirmed, notwithstanding
the absence of prior legislative approval.
  S 2. Section 23 of the town law is amended by adding a new subdivision
30 to read as follows:
