BILL NUMBER: S6894 TITLE OF BILL : An act to amend the penal law, in relation to sex trafficking of persons less than eighteen years old PURPOSE : To eliminate the requirement to prove force, fraud or coercion in prosecutions for sex trafficking SUMMARY OF PROVISIONS : Section one amends paragraph (h) of subdivision 5 of section 230.34 of the penal law, as added by chapter 74 of the laws of 2007, and adds a new subdivision 6 to provide that a person who intentionally advances or profits from prostitution by knowingly advancing prostitution of a person less than eighteen years old is guilty of sex trafficking. Section two provides the effective date. JUSTIFICATION : Since 2007, New York State has taken significant steps to hold both sex and labor traffickers accountable. In 2015, New York strengthened its criminal justice response to trafficking with the Trafficking Victims Protection and Justice Act ("TVPJA," Ch. 368 of 2015),

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to sex trafficking of persons less than eighteen years old THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (h) of subdivision 5 of section 230.34 of the penal law, as added by chapter 74 of the laws of 2007, is amended and a new subdivision 6 is added to read as follows: (h) perform any other act which would not in itself materially benefit the actor but which is calculated to harm the person who is patronized materially with respect to his or her health, safety, or immigration status[.]; OR 6. KNOWINGLY ADVANCING PROSTITUTION OF A PERSON LESS THAN EIGHTEEN YEARS OLD. S 2. This act shall take effect on the ninetieth day after it shall have become a law.
