GLICK -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development AN ACT to amend the Hudson river park act, in relation to permitting the construction of an art installation within the boundaries of pier 52 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 8 of chapter 592 of the laws of 1998, constituting the Hudson river park act, is amended by adding a new paragraph (f) to read as follows: (F) NOTWITHSTANDING THE PROVISIONS OF THIS SUBDIVISION OR SECTION 382-A OF CHAPTER 190 OF THE LAWS OF 1990, A SIGNIFICANT PROPOSED ACTION IDENTIFIED AS AN ART INSTALLATION PROPOSED TO THE WHITNEY MUSEUM BY DAVID HAMMONS AND ENTITLED DAY'S END, CONSISTING OF A LIFE-SIZE SKELETAL REPLICA OF THE PIER 52 SHED THAT IS APPROXIMATELY 52 FEET TALL, 325 FEET LONG AND 65 FEET WIDE (FOLLOWING THE GENERAL OUTLINE, DIMENSION, AND LOCATION OF THE ORIGINAL PIER SHED), MAY BE CONSTRUCTED, MAINTAINED AND REPAIRED BY THE WHITNEY MUSEUM WITHIN THE HISTORIC FOOTPRINT OF PIER 52. SUCH ART INSTALLATION SHALL COMPLY WITH ALL OTHER APPLICABLE FEDERAL, STATE AND LOCAL LAWS. THE ART INSTALLATION AUTHORIZED BY THIS PARAGRAPH SHALL NOT BE MATERIALLY ALTERED, SOLD, LEASED, EXCHANGED, DONATED, SUBJECTED TO CONCESSION AGREEMENT, OR USED FOR OTHER THAN ITS ORIGINAL PURPOSE WITHOUT THE EXPRESS AUTHORITY OF AN ACT OF THE LEGISLATURE. ANY AGREEMENT RELATED TO THE INSTALLATION AUTHORIZED BY THIS PARAGRAPH BETWEEN THE TRUST AND THE WHITNEY MUSEUM, OR ITS REPRESENTATIVE, SHALL BE POSTED ON THE HUDSON RIVER PARK WEBSITE UNDER "NY STATE REQUIRED REPORTS AND INFORMATION", FOR PUBLIC REVIEW FOR THE DURATION OF SUCH AGREEMENT AND THE EXISTENCE OF SUCH INSTALLATION. § 2.
