 AN ACT to amend the social services law, in relation to the purchase  of
   multivitamin-mineral dietary supplements with benefits through SNAP
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 95 of the social services law is amended by  adding
 a new subdivision 11 to read as follows:
   11.  (A)  THE OFFICE SHALL APPLY FOR A WAIVER FROM THE FEDERAL GOVERN-
 MENT WHICH WOULD ALLOW FOR THE PURCHASE OF MULTIVITAMIN-MINERAL  DIETARY
 SUPPLEMENTS  WITH BENEFITS THROUGH THE SUPPLEMENTAL NUTRITION ASSISTANCE
 PROGRAM. THE WAIVER SHALL BE FILED WITHIN NINETY DAYS OF  THE  EFFECTIVE
 DATE OF THIS SUBDIVISION.
   (B)  FOR  PURPOSES  OF THIS SUBDIVISION, "MULTIVITAMIN-MINERAL DIETARY
 SUPPLEMENTS" MEANS A SUBSTANCE THAT:
   (I) PROVIDES AT LEAST HALF OF THE VITAMINS AND MINERALS FOR WHICH  THE
 NATIONAL  ACADEMY  OF MEDICINE ESTABLISHES DIETARY REFERENCE INTAKES, AT
 LEAST FIFTY PERCENT OR MORE OF THE DAILY SERVING AS  DETERMINED  BY  THE
 FOOD AND DRUG ADMINISTRATION; AND
   (II)  DOES  NOT EXCEED THE TOLERABLE UPPER INTAKE LEVELS AS DETERMINED
 BY THE NATIONAL ACADEMY OF MEDICINE.
   § 2. This act shall take effect immediately.
