LIFTON -- read once and referred to the Committee on Election Law AN ACT to require the state to enter into a contract with an entity which shall share and process data that relates to the maintenance of the state's voter registration lists and provides regular reports to the state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state shall enter into a contract with an entity which seeks to lessen the burdens of government by facilitating the collab- oration of state and local government units to conduct research, develop technology, and perform other charitable and educational activities designed to reduce the costs and increase the accuracies and efficien- cies associated with their use of voter registration systems. Such entity shall provide a service to the state which includes sharing and processing data that relates to the maintenance of the state's voter registration lists and providing regular reports to the state on, at least, a monthly basis. Such entity shall also require a commitment by the state to contact eligible but unregistered residents identified by the voter registration system to educate such residents on the most efficient means to register to vote and to contact voters whose regis- tration information is identified as inaccurate or outdated to provide education on how to update the voter's record. § 2. a. The governor shall authorize state agencies to transmit to the entity with which the state contracts pursuant to section one of this act: (1) all inactive and active voter files, excluding those records that are confidential or protected from disclosure by law; (2) all licensing or identification records contained in the motor vehicle data- base, excluding those fields unrelated to voter eligibility, such as fields related to an individual's driving record; and (3) any other data requested by the entity or which the governor believes is equivalent to EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

The election law is amended by adding a new section 5-616 to read as follows: § 5-616. STATEWIDE VOTER REGISTRATION LIST MAINTENANCE. 1. THE BOARD OF ELECTIONS MAY ENTER INTO A CONTRACT WITH AN ENTITY WHICH SEEKS TO LESSEN THE BURDENS OF GOVERNMENT BY FACILITATING THE COLLABORATION OF STATE AND LOCAL GOVERNMENT UNITS TO CONDUCT RESEARCH, DEVELOP TECHNOLO- GY, AND PERFORM OTHER CIVIC AND EDUCATIONAL ACTIVITIES DESIGNED TO REDUCE THE COSTS AND INCREASE THE ACCURACIES AND EFFICIENCIES ASSOCIATED WITH THEIR USE OF VOTER REGISTRATION SYSTEMS. SUCH ENTITY SHALL PROVIDE A SERVICE TO THE STATE WHICH INCLUDES SHARING AND PROCESSING DATA THAT RELATES TO THE MAINTENANCE OF THE STATE'S VOTER REGISTRATION LISTS AND PROVIDING REGULAR REPORTS TO THE BOARD OF ELECTIONS ON, AT LEAST, A MONTHLY BASIS. THE BOARD OF ELECTIONS SHALL CONTACT ELIGIBLE BUT UNREG- ISTERED RESIDENTS IDENTIFIED BY THE VOTER REGISTRATION SYSTEM TO EDUCATE SUCH RESIDENTS ON THE MOST EFFICIENT MEANS TO REGISTER TO VOTE AND TO CONTACT VOTERS WHOSE REGISTRATION INFORMATION IS IDENTIFIED AS INACCU- RATE OR OUTDATED TO PROVIDE EDUCATION ON HOW TO UPDATE THE VOTER'S RECORD. 2.
