 AN ACT to amend the public health law, in relation to  autism  screening
   for children three years of age and under
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Paragraphs (b) and (c) of subdivision 1 of  section  2500-j
 of  the  public health law, as added by chapter 335 of the laws of 2008,
 are amended and a new paragraph (d) is added to read as follows:
   (b) a provider/parental dialogue, utilizing the modified checklist for
 autism in toddlers as a reference, intended to educate parents in regard
 to autism spectrum disorders; [and]
   (c) an appropriate referral mechanism for  children  who,  based  upon
 results  of the aforementioned screening process, require further evalu-
 ation[.]; AND
   (D) DEVELOPMENTAL SCREENINGS FOR CHILDREN THREE YEARS OF AGE AND YOUN-
 GER WHO ARE SCREENED UNDER THIS SECTION. SUCH  SCREENINGS  SHALL  BE  IN
 COMPLIANCE  WITH THE PERIODICITY SCHEDULE AND STANDARDIZED AND VALIDATED
 SCREENING   TOOLS   THAT   HAVE   BEEN   ESTABLISHED   BY   THE   BRIGHT
 FUTURES/AMERICAN  ACADEMY OF PEDIATRICS RECOMMENDATIONS FOR PREVENTATIVE
 HEALTH CARE AND ANY SUBSEQUENT UPDATES TO THOSE RECOMMENDATIONS.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law; provided, however, the amendment and/or repeal of any
 rule  or  regulation necessary for the implementation of this act on its
 effective date are authorized and directed to be made and  completed  on
 or before such effective date.

 AN  ACT  to amend the public health law, in relation to autism screening
   for children three years of age and under
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The opening paragraph of subdivision 1 of section 2500-j of
 the  public  health law, as added by chapter 335 of the laws of 2008, is
 amended to read as follows:
   The commissioner shall establish, for use by  pediatric  primary  care
 providers,  best  practice protocols for early screening of children for
 autism spectrum disorders, INCLUDING BUT NOT  LIMITED  TO  DEVELOPMENTAL
 SCREENING  FOR  CHILDREN  THREE  YEARS  OF AGE AND UNDER. Such protocols
 shall incorporate standards and guidelines established by  the  American
 Academy of [Pediatricians] PEDIATRICS, SHALL BE UPDATED AT LEAST BIENNI-
 ALLY, and shall include, but not be limited to:
   § 2. This act shall take effect immediately.
