BILL NUMBER: S1243 TITLE OF BILL : An act to amend the education law, in relation to eligibility for tuition assistance program awards for certain undergraduates who must transfer to another institution as a result of a permanent college closure PURPOSE : To extend students' eligibility to receive Tuition Assistance Program when forced to transfer due to permanent school closure. SUMMARY OF PROVISIONS : Section 1. Amends subdivision two of section 667 of the education law to extend students' eligibility to receive Tuition Assistance Program (TAP) funds when students' permanent school closure forces students to transfer between institutions. Students would be eligible for two additional semesters of TAP or their equivalent as determined by the Commissioner. Section 2. Sets forth the effective date. JUSTIFICATION : This bill seeks to extend the duration for which students are eligible
to receive TAP when faced with permanent school closures. Current statutory provisions permit students to receive up to eight semesters or the equivalent of four years of tuition assistance, if they meet the qualifying requirements. This bill would lessen the financial burden placed on students who have to transfer between institutions under these special circumstances by prolonging their eligibility for tuition assistance by two additional semesters. The extension would help to alleviate the additional costs students face when they have to lengthen their time of study unexpectedly due to permanent school closure. Recently, Dowling College, in Suffolk County, abruptly closed its doors to students after becoming debt ridden and failing to stabilize itself. The 48 year old liberal arts school had students enrolled across various academic programs, all of which had to transfer to other higher education institutions in order to complete the necessary academic credits required to receive a degree in their field of study. Unfortunately, transferring between institutions can often result in the loss of earned academic credits because not all credits are seamlessly accepted for degree completion between institutions. As was the case with students from Dowling College, many students found themselves having to extend their years of study beyond their original projected date of graduation because they lost earned academic credit hours that were not accepted by the institution they were attempting to transfer to in order to complete degrees. This unplanned loss of credit resulted in an extended time in school and therefore a greater expense to students, as they find themselves having to pay for additional unanticipated semesters of schooling needed to complete their degree. LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to eligibility for tuition assistance program awards for certain undergraduates who must transfer to another institution as a result of a permanent college closure THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 667 of the education law, as amended by section 1 of part J of chapter 58 of the laws of 2011, is amended to read as follows: 2. Duration. No undergraduate shall be eligible for more than four academic years of study, or five academic years if the program of study normally requires five years. Students enrolled in a program of remedial study, approved by the commissioner in an institution of higher educa- tion and intended to culminate in a degree in undergraduate study shall, for purposes of this section, be considered as enrolled in a program of study normally requiring five years. An undergraduate student enrolled in an eligible two year program of study approved by the commissioner shall be eligible for no more than three academic years of study. AN UNDERGRADUATE STUDENT ENROLLED IN AN APPROVED TWO OR FOUR-YEAR PROGRAM OF STUDY APPROVED BY THE COMMISSIONER WHO MUST TRANSFER TO ANOTHER INSTITUTION AS A RESULT OF PERMANENT COLLEGE CLOSURE SHALL BE ELIGIBLE FOR TWO ADDITIONAL SEMESTERS, OR THEIR EQUIVALENT, AS DETERMINED BY THE COMMISSIONER, IN ORDER TO COMPLETE HIS OR HER PROGRAM. Any semester, quarter, or term of attendance during which a student receives any award under this article, after the effective date of the former scholar incentive program and prior to academic year nineteen hundred eighty- nine--nineteen hundred ninety, shall be counted toward the maximum term of eligibility for tuition assistance under this section, except that any semester, quarter or term of attendance during which a student EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
LBD07461-01-7 S. 1243 2 received an award pursuant to section six hundred sixty-six of this subpart shall be counted as one-half of a semester, quarter or term, as the case may be, toward the maximum term of eligibility under this section. Any semester, quarter or term of attendance during which a student received an award pursuant to section six hundred sixty-seven-a of this subpart shall not be counted toward the maximum term of eligi- bility under this section. § 2. This act shall take effect immediately.
