 BILL NUMBER:  S1469

 TITLE OF BILL :  An act to amend the education law, in relation to
the salary of certain teachers providing instruction in career and
technical education to school age students

 PURPOSE :

To provide adequate funding at BOCES component school districts for
career and technical education teachers.

 SUMMARY OF PROVISIONS :

Section 1 amends the education law relating to salaries for teachers
providing instruction in career and technical education to school age
students for the 2016-2017, 2017-2018, 2018-2019, 2019-2020, 2020-2021
school years.

Section 2 provides the effective date.

 JUSTIFICATION :

This bill improves resources and programming for career and technical
education to school age students. New York State provides aid to
school districts to help them pay for services that they purchase from
BOCES, including teachers for instruction in career and technical

education. There is, however, a cap on teacher salaries which has not
been increased since 1991. Since then, New York has highlighted career
and technical education as a priority for preparing students for work
and college in the 21st century. This bill updates aid to match the
state's educational priorities in BOCES component school districts.

The expansion of Career and Technical Education (CTE) programs is
essential. For many students, CTE offers the most promising pathway to
career success. Funding and reimbursement structures, particularly
BOCES and Special Services Aids, needs improvement and expansion so
that all students may benefit from its programs. By facilitating
broader investments and public-private partnerships in these areas, we
can present an integrated career and technical curriculum to students.

As stated, the current aid formula for BOCES CTE programs has not
changed since 1990. The state only provides aid for the first $30,000
of a BOCES instructor's salary. This has the effect of reducing state
support for CTE programs and shifting the costs to local schools.
What results is the underinvestment of high-quality programs that
provide students with the skills employers demand. According to SED,
more than 90% of CTE students graduate with a Regents diploma, some
with Advanced Designation. By increasing the aidable salary for all
CTE programs this bill will significantly improve CTE services and
programs to students.

AN ACT to amend the education law, in relation to the salary of  certain
  teachers  providing  instruction  in career and technical education to
  school age students

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Paragraph b of subdivision 5 of section 1950 of the educa-
tion law, as amended by chapter 296 of the laws of 2016, is  amended  to
read as follows:
  b.  The  cost of services herein referred to shall be the amount allo-
cated to each component school district  by  the  board  of  cooperative
educational  services  to  defray  expenses  of  such  board,  including
approved expenses from the testing of potable water systems of  occupied
school  buildings under the board's jurisdiction as required pursuant to
section eleven hundred ten of the public health law,  except  that  that
part of the salary paid any teacher, supervisor or other employee of the
board  of  cooperative educational services which is in excess of thirty
thousand dollars shall not be such an approved expense, and except  also
that  administrative  and clerical expenses shall not exceed ten percent
of the total expenses for purposes of this computation.  PROVIDED HOWEV-
ER, THAT FOR TEACHERS PROVIDING  INSTRUCTION  IN  CAREER  AND  TECHNICAL
EDUCATION  TO  SCHOOL  AGE  STUDENTS, THE SALARY, TO BE CONSIDERED AS AN
APPROVED EXPENSE, SHALL NOT EXCEED THIRTY-FOUR THOUSAND DOLLARS FOR  THE
TWO  THOUSAND SEVENTEEN--TWO THOUSAND EIGHTEEN SCHOOL YEAR; THIRTY-EIGHT
THOUSAND DOLLARS FOR THE TWO THOUSAND  EIGHTEEN--TWO  THOUSAND  NINETEEN
SCHOOL  YEAR; FORTY-TWO THOUSAND DOLLARS FOR THE TWO THOUSAND NINETEEN--
TWO THOUSAND TWENTY SCHOOL YEAR; FORTY-SIX THOUSAND DOLLARS FOR THE  TWO
THOUSAND TWENTY--TWO THOUSAND TWENTY-ONE SCHOOL YEAR; AND FIFTY THOUSAND
DOLLARS  FOR THE TWO THOUSAND TWENTY-ONE--TWO THOUSAND TWENTY-TWO SCHOOL
YEAR, AND THEREAFTER. Any gifts, donations or  interest  earned  by  the

board  of  cooperative educational services or on behalf of the board of
cooperative educational services by the dormitory authority or any other
source shall not be deducted in determining the cost of  services  allo-
cated  to  each component school district. Any payments made to a compo-
nent school district by the board of  cooperative  educational  services
pursuant to subdivision eleven of section six-p of the general municipal
law  attributable  to  an  approved cost of service computed pursuant to
this subdivision shall be deducted from the cost of  services  allocated
to  such  component  school  district.    The  expense of transportation
provided by the board of cooperative educational  services  pursuant  to
paragraph  q  of  subdivision four of this section shall be eligible for
aid apportioned pursuant to  subdivision  seven  of  section  thirty-six
hundred  two  of  this  chapter  and no board of cooperative educational
services transportation expense shall be an approved  cost  of  services
for  the  computation  of  aid  under  this  subdivision. Transportation
expense pursuant to paragraph q of  subdivision  four  of  this  section
shall  be  included  in the computation of the ten percent limitation on
administrative and clerical expenses.
  § 2. This act shall take effect immediately.

There is, however, a cap on teacher salaries, which has not been
