BILL NUMBER: S2213 TITLE OF BILL : An act to amend the education law, in relation to tuition assistance program awards PURPOSE : To raise the net taxable income eligible for Tuition Assistance Program (TAP) awards from $80,000 to $100,000, raise the minimum TAP award to $1,000 and adjust the formula for awards. SUMMARY OF PROVISIONS : Section 1 amends subparagraph (ii) of paragraph a of subdivision 3 of section 667 of the education law to increase the net taxable income threshold from $80,000 to $100,000. This also redefines the TAP schedule so the lowest minimum TAP award will be $1,000. This provision would also reform the TAP schedule by creating new brackets for incomes and provide for a defined TAP award amount for each income bracket. The current TAP schedule would continue to be in effect for the 2016-2017 academic year and this formula would replace that schedule for the 2017-2018 academic year and thereafter. Section 2 sets forth the effective date. JUSTIFICATION :

Subparagraph (ii) of paragraph a of subdivision 3 of section 667 of the education law, as amended by section 1 of part B of chapter 60 of the laws of 2000, is amended to read as follows: (ii) Except for students as noted in subparagraph (iii) of this para- graph, the base amount as determined from subparagraph (i) of this para- graph, shall be reduced in relation to income as follows: FOR THE 2016-2017 ACADEMIC YEAR: Amount of income Schedule of reduction of base amount (A) Less than seven thousand None dollars (B) Seven thousand dollars or Seven per centum of excess more, but less than eleven over seven thousand dollars thousand dollars (C) Eleven thousand dollars or Two hundred eighty dollars more, but less than eighteen plus ten per centum thousand dollars of excess over eleven thousand dollars (D) Eighteen thousand dollars or Nine hundred eighty dollars more, but not more than plus twelve per centum of eighty thousand excess over eighteen dollars thousand dollars EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
