BILL NUMBER: S3004 TITLE OF BILL : An act to amend the environmental conservation law, in relation to the period for the taking of striped bass PURPOSE : To alter the period of time in which striped bass are prohibited from being taken in the marine waters of New York State from December 15 thru April 15 to January 1 thru April 15. SUMMARY OF PROVISIONS : Subdivision 4 of section 13-0347 of the Environmental Conservation Law is amended to extend the striped bass season in the marine waters of New York State until December 315. JUSTIFICATION : Federal and State fishing regulations, changes in water temperature and seasonal migration patterns along with weather events and patterns have all negatively affected New York's commercial fishing industry. Today's commercial fishing fleet has been decimated and it is only a small percentage of what it once was. As recently witnessed with Hurricane Sandy, the potential for an extreme weather event to damage fishing infrastructure, further financially cripple our fisherman and

MAGEE -- read once and referred to the Committee on Environ- mental Conservation AN ACT to amend the environmental conservation law, in relation to the period for the taking of striped bass THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 13-0347 of the environmental conservation law, as added by chapter 990 of the laws of 1983, is amended to read as follows: 4. No person shall take or land striped bass in the marine waters of New York state during the period [December 15] JANUARY 1 to April 15 inclusive. For purposes of this section "marine waters" means the tidal waters of the state including the Hudson River from the Battery to the George Washington bridge, and "land" shall mean the setting or putting on shore from any boat or vessel or to bring to any port or docking place any striped bass. Possession of striped bass imported into New York other than by boat is not prohibited during the closed season so long as such striped bass are of legal minimum size. Striped bass unin- tentionally taken in violation of this subdivision shall be returned to the water immediately without unnecessary injury. § 2. This act shall take effect immediately.
