BILL NUMBER: S4076 TITLE OF BILL : An act to amend the town law and the public officers law, in relation to waiving the residency requirement for the town justice in the town of Boylston, in Oswego county PURPOSE : To waive the residency requirement for the town justice in the town of Boylston. SUMMARY OF PROVISIONS : Section 1 amends Town Law at section 23 by adding a new subdivision, 31, to waive the residency requirement as it relates to the selection of town justice in the Town of Boylston, in Oswego County. Section 2 amends the public officers law at section 2 to add a new subdivision, 66, to exempt the town of Boylston from the requirement that an individual be a resident of the political subdivision or municipal corporation of the state for which he or she shall be chosen, or within which his or her official function is required to be exercised. Further, this section requires that the individual selected to hold office of town justice in the town of Boylston reside in a town which adjoins such town and which is in the county of Oswego.

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law and the public officers law, in relation to waiving the residency requirement for the town justice in the town of Boylston, in Oswego county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 23 of the town law is amended by adding a new subdivision 31 to read as follows: 31. NOTWITHSTANDING SUBDIVISION ONE OF THIS SECTION, IN THE TOWN OF BOYLSTON, OSWEGO COUNTY, THE PERSON PERFORMING THE FUNCTION OF TOWN JUSTICE NEED NOT BE AN ELECTOR OF SUCH TOWN. PROVIDED, HOWEVER, THE PERSON PERFORMING THE FUNCTION OF TOWN JUSTICE IN ANY OTHER TOWN SHALL BE AN ELECTOR OF SUCH TOWN, UNLESS OTHERWISE PROVIDED BY AN ACT OF THE STATE LEGISLATURE. § 2. Section 3 of the public officers law is amended by adding a new subdivision 66 to read as follows: 66. IN THE TOWN OF BOYLSTON, OSWEGO COUNTY, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR SHE SHALL BE CHOSEN, OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTION IS REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF TOWN JUSTICE OF THE TOWN OF BOYLSTON; PROVIDED THAT SAID PERSON RESIDES IN A TOWN WHICH ADJOINS SUCH TOWN AND WHICH IS IN THE COUNTY OF OSWEGO. PROVIDED, HOWEVER, THE PERSON PERFORMING THE FUNCTIONS OF TOWN JUSTICE IN ANY OTHER TOWN SHALL BE A RESIDENT OF SUCH TOWN, UNLESS OTHERWISE PROVIDED BY LAW. § 3.
