BILL NUMBER: S4265 Revised 3/1/17 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to the sale of ice cream or other frozen desserts made with wine PURPOSE : To allow for the sale of wine ice cream in packages that are less than one pint. SUMMARY OF PROVISIONS : Section 1 repeals the minimum packaging requirements for the sale of wine ice cream. Section 2 is the effective date. EXISTING LAW : Currently, New York allows for the sale of wine ice cream in packages that are one pint in volume or greater, but not less. JUSTIFICATION : The sale of wine ice cream was enacted into law in 2008. Since that

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to the sale of ice cream or other frozen desserts made with wine THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (i) and the opening paragraph of subparagraph (ii) of paragraph (a) of subdivision 15 of section 200 of the agricul- ture and markets law, as amended by chapter 42 of the laws of 2011, are amended to read as follows: (i) each package is a sealed package [containing at least one pint], as received from the manufacturer or distributor; each sealed package [containing at least one pint], as received from the manufacturer or distributor, in a format to be established or approved by the commissioner, prominently bears the following state- ments: § 2.
