BILL NUMBER: S4530 TITLE OF BILL : An act to amend the education law, in relation to reimbursement methodologies for tuition PURPOSE : This legislation will require the commissioners of education and social services to develop separate reimbursement methodologies for tuition and maintenance of approved private schools and special act school districts. SUMMARY OF PROVISIONS : Section two of the bill amends education law section 4405 (4) to provide that the commissioner of education and the commissioner of social services shall develop reimbursement methodologies for the tuition and maintenance components of approved private schools and special act school districts. Section two establishes the effective date. JUSTIFICATION : "Special Act School Districts" are public school districts created by special action of the legislature for the purpose of providing

MURPHY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to reimbursement method- ologies for tuition THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 4 of section 4405 of the educa- tion law, as amended by chapter 53 of the laws of 1990, is amended to read as follows: a. The commissioner [of education] and the commissioner of social services shall develop reimbursement methodologies for the tuition and maintenance components of approved private schools and special act school districts. The commissioner [of education], in consultation with the appropriate state agencies and departments, shall have responsibil- ity for developing [a] reimbursement [methodology] METHODOLOGIES for tuition which shall be based upon appropriate educational standards promulgated pursuant to regulations of the commissioner [of education]. The commissioner of social services, in consultation with appropriate state agencies and departments, shall have responsibility for developing [a] reimbursement [methodology] METHODOLOGIES for maintenance, pursuant to section three hundred ninety-eight-a of the social services law and the regulations promulgated thereunder. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09611-01-7
