BILL NUMBER: S4574 TITLE OF BILL : An act to amend the executive law, in relation to the creation of a study by the commissioner of the office of children and family services regarding staffing levels SUMMARY OF PROVISIONS : Section 1 amends the Executive Law by adding provisions calling for the creation of an annual study by the commissioner of the Office of Children and Family Services on the ratio of non-administrative staff to residents in their facilities, and establishes some of the parameters of this study, including that it must be delivered to the legislature on the first of each year. Section 2 establishes the effective date as immediately. JUSTIFICATION : Recently, there has been a spate of attacks on staff in facilities under the Office of Children and Family Services, particularly at the Brookwood Secure Center in the City of Hudson. There, Charles Kisembo, an aide, was attacked by a resident with a blunt object and hospitalized. As a result, he had to be treated for brain swelling and

MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families AN ACT to amend the executive law, in relation to the creation of a study by the commissioner of the office of children and family services regarding staffing levels THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 500 of the executive law is amended by adding a new subdivision 2-a to read as follows: 2-A. THE COMMISSIONER SHALL ESTABLISH AND CONDUCT AN ANNUAL STUDY, TO BE DELIVERED TO THE LEGISLATURE ON OR BEFORE THE FIRST OF JANUARY OF EACH YEAR, ON FACILITIES OPERATED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES REGARDING THE RATIO OF NON-ADMINISTRATIVE STAFF TO RESIDENTS. IT SHALL BE NOTED IN THESE ANNUAL STUDIES THE NUMBER OF EMPLOYEES WHO ARE CURRENTLY OUT OF DUTY DUE TO AN ON THE JOB INCIDENT AND ARE CURRENT- LY ON WORKERS' COMPENSATION LEAVE. THESE ANNUAL STUDIES SHALL ALSO INCLUDE THE NUMBER OF STAFF, SPECIFICALLY DESCRIBING THEIR POSITIONS, WHO ARE INVOLVED IN ANY REPORTED INCIDENT INVOLVING THE MISCONDUCT OF A RESIDENT AND A COMPARISON OF THIS DATA TO OTHER OFFICE OF CHILDREN AND FAMILY SERVICES FACILITIES OF SIMILAR SIZE AND A SIMILAR TYPE AS WELL AS THE DATE AND TIME OF SUCH INCIDENTS. § 2. (B) UTILIZING THE INFORMATION REQUIRED BY PARAGRAPH (A) OF THIS SUBDI- VISION FOR EACH FACILITY OPERATED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES, THE COMMISSIONER SHALL SUBMIT A REPORT TO THE LEGISLATURE NO LATER THAN JANUARY FIRST OF EACH YEAR. § 2.
