Prohibits the authority from contracting or purchasing energy or environmental attributes when such energy is transmitted over an electric transmission line that interconnects a location outside of the United States when the transmission does not provide access to electric generating facilities within the state.

BILL NUMBER: S5126 TITLE OF BILL : An act to amend the public authorities law, in relation to the authority to contract for energy PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to ensure that the New York Power Authority (NYPA) does not encourage the development of transmission lines that discriminate against electric generating facilities in New York state by contracting to acquire energy, or environmental attributes associated with energy, that is generated by electric generating facilities located outside of the country and is delivered over transmission lines that do not provide access to electric generating facilities in New York to transmit their energy within New York State. SPECIFIC PROVISIONS : Section 1 of this bill would apply to energy transmitted over an electric transmission line that: (1) may be, but is not limited to, a high voltage direct current electric transmission line; (2) enters commercial operation after the effective date of this act; (3) connects a location outside of the Unites States to a location within New York State; and (4) does not provide access within New York State for the state's electric generating facilities also to transmit their

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public authorities law, in relation to the authority to contract for energy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1005 of the public authorities law is amended by adding a new closing paragraph to read as follows: NOTWITHSTANDING ANY LAW, RULE, REGULATION, POLICY, ORDER OR EXECUTIVE ACTION TO THE CONTRARY, THE AUTHORITY SHALL NOT CONTRACT FOR OR OTHER- WISE PURCHASE OR ACQUIRE POWER OR ENERGY, OR ASSOCIATED ENVIRONMENTAL ATTRIBUTES, FROM ANY INDIVIDUAL, TRUSTEE, PARTNERSHIP, ASSOCIATION, CORPORATION, COMPANY, MUNICIPALITY, POLITICAL SUBDIVISION OR OTHER LEGAL ENTITY IF SUCH ENERGY IS TRANSMITTED OVER AN ELECTRIC TRANSMISSION LINE, INCLUDING BUT NOT LIMITED TO A HIGH VOLTAGE DIRECT CURRENT ELECTRIC TRANSMISSION LINE, THAT ENTERS COMMERCIAL OPERATION AFTER THE EFFECTIVE DATE OF THIS PARAGRAPH AND THAT INTERCONNECTS A LOCATION OUTSIDE THE TERRITORIAL LIMITS OF THE UNITED STATES TO A LOCATION WITHIN THE STATE AND SUCH TRANSMISSION LINE DOES NOT PROVIDE ACCESS WITHIN THE STATE TO ELECTRIC GENERATING FACILITIES LOCATED WITHIN THE STATE TO TRANSMIT SUCH POWER OR ENERGY TO A LOCATION WITHIN THE STATE. § 2.
