BILL NUMBER: S5357 TITLE OF BILL : An act to amend the public health law, in relation to adding substances to the schedules of controlled substances PURPOSE : This bill would update the State controlled substances schedules, promoting consistency with the federal schedules and promoting health and safety. SUMMARY OF PROVISIONS : Section 1 of the bill would add a synthetic opioid analgesic; often known as AH-7921, and seven fentantyl analogs to Schedule I(b) of Public Health Law (PHL) § 3306. The section would also add any controlled substance listed in 21 U.S.C. § 812, Schedule I(a), that is not otherwise listed in state Schedule 1(b) to such schedule. Section 2 of the bill would amend PHL § 3306, Schedule I(c) to add the controlled substances listed in 21 U.S.C. § 812, Schedule I(b), if not already listed therein. Section 3 of the bill would amend PHL § 3306, Schedule I(d) to correct the spelling of ibogane.

Subdivision (b) of schedule I of section 3306 of the public health law is amended by adding nine new paragraphs 56, 57, 58, 59, 60, 61, 62, 63 and 64 to read as follows: (56) 3,4-DICHLORO-N-{(1-DIMETHYLAMINO)CYCLOHEXYLMETHYL}BENZAMIDE. SOME TRADE OR OTHER NAMES: AH-7921. (57) N-(1-PHENETHYLPIPERIDIN-4-YL)-N-PHENLYACETAMIDE (ACETYL FENTA- NYL). (58) -(1-PHENETHYLPIPERIDIN-4-YL)-N-PHENYLBUTYRAMIDE (BUTYRYL FENTA- NYL). BILL NUMBER: S5357A TITLE OF BILL : An act to amend the public health law, in relation to adding substances to the schedules of controlled substances PURPOSE : The purpose of this bill is to update the State controlled substances schedules, promoting consistency with the federal schedules, and promoting health and safety. Section 3 of the bill would add several substances to Schedule 1(d) of PHL§ 3306, to conform with the federal schedule. Section 4 of the bill would add the substance thiafentanil to Schedule I1(c) of PHL§ 3306, to conform with the federal schedule.

Subdivision (d) of schedule I of section 3306 of the public health law is amended by adding thirty-five new paragraphs 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66, 67, 68, 69, and 70 to read as follows: (36) 5-METHOXY-N,N-DIMETHYLTRYPTAMINE.
