BILL NUMBER: S5377 TITLE OF BILL : An act to amend the racing, pari-mutuel wagering and breeding law, in relation to the operation of commercial casinos PURPOSE OF THE BILL : This bill would clarify the permissibility of credit to patrons at commercial casinos. SUMMARY OF PROVISIONS : Section 1 of the bill would amend Racing, Pari-mutuel wagering and Breeding Law § 1339 to clarify that cashing checks is permitted pursuant to the requirements of subdivisions two through eight of that section, and permit gaming facility licensees to offer other forms of credit to patrons if done so according to the rules of the Gaming Commission. Section 2 of the bill would make the bill effective immediately. JUSTIFICATION : The ability of commercial casinos to extend credit to players taking part in gaming activity is an important component of commercial casino operations. BONACIC -- (at request of the New York State Gaming Commission) -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wagering AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to the operation of commercial casinos THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 1339 of the racing, pari-mutuel wagering and breeding law, as added by chapter 174 of the laws of 2013, is amended to read as follows: 1. [Except as otherwise provided in this section, no] NO gaming facil- ity licensee or any person licensed under this article, and no person acting on behalf of or under any arrangement with a gaming facility licensee or other person licensed under this article, shall: (a) [Cash] CASH any check[, make any loan, or otherwise provide or allow to any person any credit or advance of anything of value or which represents value] to enable any person to take part in gaming activity as a player, OTHER THAN AS PERMITTED BY SUBDIVISIONS TWO THROUGH EIGHT OF THIS SECTION; [or] (b) [Release] MAKE ANY LOAN, OR OTHERWISE PROVIDE OR ALLOW TO ANY PERSON ANY CREDIT OR ADVANCE OF ANYTHING OF VALUE, OR THAT REPRESENTS VALUE TO ENABLE ANY PERSON TO TAKE PART IN GAMING ACTIVITY AS A PLAYER, OTHER THAN AS PERMITTED BY PARAGRAPH (A) OF THIS SUBDIVISION, UNLESS DONE PURSUANT TO THE RULES OF THE COMMISSION; OR (C) RELEASE or discharge any debt, either in whole or in part, or make any loan [which] THAT represents any losses incurred by any player in gaming activity, [without maintaining] UNLESS a written record [thereof in accordance with] OF THE TRANSACTION OR ACTIVITY IS MAINTAINED PURSU- ANT TO the rules of the commission. § 2.
