BILL NUMBER: S5690 TITLE OF BILL : An act to amend the penal law, in relation to the crime of assault of an operator of a for-hire vehicle PURPOSE OR GENERAL IDEA OF THE BILL : To protect for-hire drivers, including taxi drivers, from being assaulted on the job by posting signs in taxis to alert passengers of the punishment for assaulting taxi workers; and to include for-hire drivers in the list of victims of felony assault. SUMMARY OF SPECIFIC PROVISIONS : Section 1 titles the bill the "taxi driver protection act." Section 2 amends section 60.07 of the penal law to require every for-hire vehicle to post a sign on the interior of such vehicle that states "ATTENTION: Assaulting a Taxi Driver Is Punishable By Up To Twenty-Five Years In Prison." Section 3 amends Subdivision 11 of section 120.05 of the penal law to include drivers of for-hire vehicles in the occupations listed under victims of felony assault.

ALCANTARA -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the crime of assault of an operator of a for-hire vehicle THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "taxi driv- er protection act". § 2. Section 60.07 of the penal law is amended by adding a new subdi- vision 3 to read as follows: 3. EVERY FOR-HIRE VEHICLE SHALL POST A SIGN ON THE INTERIOR OF SUCH VEHICLE STATING IN NOT LESS THAN SIXTEEN POINT PRINT THAT "ATTENTION: ASSAULTING A TAXI DRIVER IS PUNISHABLE BY UP TO TWENTY-FIVE YEARS IN PRISON". § 3. Subdivision 11 of section 120.05 of the penal law, as separately amended by chapters 268 and 281 of the laws of 2016, is amended to read as follows: 11. With intent to cause physical injury to a train operator, ticket inspector, conductor, signalperson, bus operator, station agent, station cleaner or terminal cleaner employed by any transit agency, authority or company, public or private, whose operation is authorized by New York state or any of its political subdivisions, a city marshal, a school crossing guard appointed pursuant to section two hundred eight-a of the general municipal law, a traffic enforcement officer, traffic enforce- ment agent, prosecutor as defined in subdivision thirty-one of section 1.20 of the criminal procedure law, sanitation enforcement agent, New York city sanitation worker, public health sanitarian, New York city public health sanitarian, registered nurse, licensed practical nurse, emergency medical service paramedic, [or] emergency medical service technician OR FOR-HIRE DRIVER, he or she causes physical injury to such train operator, ticket inspector, conductor, signalperson, bus operator, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

BILL NUMBER: S5690B TITLE OF BILL : An act to amend the penal law, in relation to the assault of a driver of a for-hire vehicle or transportation network company driver PURPOSE OR GENERAL IDEA OF THE BILL : To protect for-hire drivers, including taxi drivers, from being assaulted on the job by posting signs in taxis to alert passengers of the punishment for assaulting taxi workers; and to include for-hire drivers in the list of victims of felony assault. SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill amends section 120.05 of penal law related to assault in the second degree to include within the offense the assault of a for-hire driver or transportation network company driver. Assaulting a for-hire driver or transportation network company driver would be a class D felony under this legislation. Section 2 of the bill states that the Act takes effect immediately.
