   when printed to be committed to the Committee  on  Commerce,  Economic
   Development and Small Business
 
 AN  ACT  to  amend  the  alcoholic  beverage control law, in relation to
   temporary permits to sell beer and wine not to be consumed on premises

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 64 of the alcoholic beverage control law is amended
 by adding a new subsection 10 to read as follows:
   10. (A) THE LIQUOR AUTHORITY IS HEREBY AUTHORIZED TO ISSUE A TEMPORARY
 PERMIT  TO  SELL  BEER AND WINE NOT TO BE CONSUMED ON PREMISES EFFECTIVE
 FOR PERIODS NOT TO EXCEED FOUR HOURS PER DAY ON NOT MORE  THAN  ONE  DAY
 EACH  WEEK  FOR  NOT  MORE THAN TWENTY WEEKS PER YEAR TO ANY HOLDER OF A
 LICENSE TO SELL LIQUOR AT RETAIL FOR CONSUMPTION ON THE  PREMISES.  SUCH
 PERMIT SHALL BE CONDITIONAL UPON COORDINATION WITH COMMUNITY ACTIVITIES,
 FESTIVALS, EVENTS OR PROMOTIONS.
   (B)  SUCH  APPLICATION  SHALL  BE  IN SUCH FORM AND SHALL CONTAIN SUCH
 INFORMATION AS SHALL BE REQUIRED BY THE RULES OF  THE  LIQUOR  AUTHORITY
 AND SHALL BE ISSUED TO ALL APPLICANTS EXCEPT FOR GOOD CAUSE SHOWN.
   (C)  AN APPLICANT FOR A PERMIT UNDER THIS SECTION SHALL PROVIDE NOTICE
 TO THE LOCAL MUNICIPALITY OF SUCH APPLICATION AS PROVIDED IN SECTION ONE
 HUNDRED TEN-B OF THIS CHAPTER.
   (D) THE FEE FOR SUCH A PERMIT SHALL BE TWENTY-FIVE  DOLLARS,  TOGETHER
 WITH A FILING FEE OF TEN DOLLARS.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.
