FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing the town of Rush, county of Monroe, to use certain property for recreational and educational purposes as well as to lease such property for agricultural use THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law and notwith- standing the provisions of a deed dated January 12, 2010 and filed in the Monroe county clerk's office in Book 10869 page 606 to the contrary, the town of Rush, county of Monroe, shall be authorized and empowered to use the land described in section two of this act for recreational and educational purposes and shall be authorized and empowered to lease the land described in section two of this act for such consideration and upon such terms, conditions and provisions as shall be mutually agreed upon between the town and the lessee for agricultural purposes. § 2. The lands referenced to in section one of this act shall consist of ALL THAT PIECE or parcel of land situate in the Town of Rush, County of Monroe, State of New York, being a portion of Lot Number 58 in Town- ship Number 11, Range 7 of the Phelps and Gorham Purchase, being bounded and described as follows: Beginning at an iron rod in the northerly bounds of the Scottsville- Rush Road (N.Y.S. Route 251) at its intersection with the division line between the lands, now or formerly, of the National Railway Historical Society, Rochester Chapter, on the east, and the lands of the Town of Rush, on the west; thence along the northerly bounds of the Scotts- ville-Rush Road, the following three (3) courses and distances: 1. N. 79° 15' 15" W., a distance of 2,089.79 feet to a point of curva- ture; 2. along a curve to the right having a radius of 2,038.24 feet, for an arc length of 276.75 feet to the point of tangency; and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
