AN ACT authorizing the city of Schenectady to alienate certain parcels
of land used as parkland and to acquire other parcels of land to
replace such parkland
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subject to the provisions of this act, the city of Schenec-
tady, acting by and through its governing body, is hereby authorized to
discontinue as parklands and alienate the lands more particularly
described in section three of this act, and to sell and convey such
parklands upon such other terms and conditions as determined by the
governing body of the city of Schenectady to the Boys & Girls Club for
the purpose of constructing a new Boys & Girls Club facility at Quacken-
bush Park.
§ 2. The authorization contained in section one of this act shall take
effect only upon the condition that the city of Schenectady shall
acquire and dedicate the lands of equal or greater fair market value
described in section four of this act as additional parklands of the
city.
§ 3. The lands authorized by section one of this act to be discontin-
ued as parklands and conveyed to the Boys & Girls Club consists of 1.35
acres and are described as follows:
All that certain tract, piece, or parcel of land situate, lying and
being in the City of Schenectady, County of Schenectady and State of New
York and being more particularly bounded and described as follows:
Beginning at a point on the division line of lands herein described as
Lot 1 on the south and lands now or formerly of Schenectady City School

District as described in Liber 279 of deeds at page 209 on the north,
said point being the northeast corner of Lot 2; thence running along
said division line North 30°59'00" East, 150.10 feet to a point with the
lands herein described as Lot 1 on the south, lands now or formerly of
Schenectady City School District on the west and lands now or formerly
of the City of Schenectady as described in Liber 222 of deeds at page
479 on the east; thence South 53°08'09" East, 151.20 feet to a point on
the division line of lands herein described as Lot 1 on the west and
lands now or formerly of The City of Schenectady on the east; thence
running along said division line South 12°44'55" East, 195.16 feet to a
point on the division line of lands herein described as Lot 1 on the
north and lands now or formerly of The City of Schenectady as described
in Liber 302 of deeds at page 18 on the south; thence running along said
division line South 78°47'04" West, 271.14 feet to a point at its inter-
section with lands herein described as Lot 1 on the east, lands of Lot 2
on the west and the lands now or formerly of The City of Schenectady on
the south; thence running along the division line of Lot 1 and Lot 2 the
following four (4) courses and distances: 1.) North 11°11'16" West,
90.73 feet to a point; 2.) North 78°47'04" East, 42.99 feet to a point;
3.) North 11°12'56" West, 49.48 feet to a point; and 4.) North 09°19'00"
East, 60.00 feet to the point or place of beginning.
Containing 1.35 Acres of land more or less.
§ 4. The replacement lands to be acquired and dedicated by the city of
Schenectady, county of Schenectady, to use as new parkland for public
park purposes are described as follows:
All that certain piece or parcel of land situate in the City of Sche-
nectady, County of Schenectady and the State of New York, lying along
the westerly line of Crane Street, being further bounded and described
as follows:
Beginning at a point located along the westerly line of Crane Street,
further located 149.10 feet northerly from the northwesterly inter-
section of Crane Street and Third Avenue, said point being the inter-
section formed by said westerly line of Crane Street with the division
line between the lands now or formerly of Wieslaw & Krystyna Cyrulik
(Book 1518, Page 601) on the south and the lands herein described on the
north and running along said division line of the following six courses:
1) South 84°36'22" West, 137.39 feet to a point; 2) South 84°36'22"
West, 42.99 feet to a point; 3) South 75°58'38" West, 32.19 feet to a
point; 4) South 09°14'09" East, 52.00 feet to a point; 5) South
87°21'19" East, 2.50 feet to a point; and 6) South 02°24'08" East, 64.00
feet to a point located on the northerly line of Third Avenue; thence in
a westerly direction and along said northerly line of Third Avenue,
North 87°21'19" West, 74.87 feet to a point being the division line of
lands now or formerly of Mohanie Lallbachan (Book 1720, Page 70) on the
west and the lands herein described on the east; thence in a northerly
and westerly direction along said division line the following two cours-
es: 1) North 02°02'52" West, 153.00 feet to a point and 2) South
77°54'49" West, 40.00 feet to a point being the division line of lands
now or formerly of Awadnarie Lallbachan (Book 1624, Page 802) on the
west and the lands herein described on the east, thence in a northerly
and westerly direction along said division line the following two cours-
es: 1) North 20°52'36" West, 12.11 feet to a point and 2) South
89°00'29" West, 1.38 feet to a point; thence in a northerly direction
and along the division line of the lands now or formerly of George David
Sr. (Book 1571, Page 733), Boodnarie and Rawattie Sewpersaud (Book 1687,
Page 210), Maharanie Latchana (Book 1624, Page 713), Michael Koronkiew-

21°26'46" West, 196.91 feet to a point on the division line of Richard
Valentine (Book 1757, Page 698) on the north and the lands herein
described on the south and east; thence in a easterly and northerly
direction along said division line the following two courses: 1) North
84°11'00" East, 5.89 feet to a point; and 2) North 13°11'50" West,
150.24 feet to a point on the southerly line of Second Avenue; thence in
an easterly direction and along the aforesaid southerly line of Second
Avenue, North 84°11'00" East, 29.30 feet to a point being the division
line of the lands now or formerly of Diaram Yeapersaud (Book 1897, Page
85) on the east and the lands herein described on the west; thence in a
southerly direction and along said division line, South 05°49'00" East,
149.00 feet to a point; thence in an easterly and northerly direction
along said lands of Yeapersaud and continuing along the lands of Kumar
and Meenawatti Gooniah (Book 1708, Page 647) the following two courses:
1) North 84°11'00" East, 66.67 feet to a point and 2) North 05°49'00"
West, 149.00 feet to a point on the southerly line of Second Avenue;
thence in an easterly direction and along said southerly line of Second
Avenue, North 84°11'00" East, 66.67 feet to a point on the division line
between the lands now or formerly of Yognie and Jankie Lakhram (Book
1867, Page 719) on the east and the lands herein described on the west;
thence in a southerly direction and along said division line, South
05°49'00" East, 149.00 feet to a point; thence in an easterly direction
and along said lands of Lakhram and continuing along the lands now or
formerly of Jason Sacks (Book 1642, Page 210), North 84°11'00" East,
57.73 feet to a point being the division line of the lands now or
formerly of Taresh and Nehru Mahabir (Book 1793, Page 262) on the east
and the lands herein describe on the west; thence in a southerly and
easterly direction and along aforesaid division line the following four
courses: 1) South 08°27'34" East, 38.40 feet to a point, 2) North
81°32'26" East, 19.10 feet to a point, 3) North 82°49'53" East, 26.10
feet to a point and 4) North 88°22'48" East, 145.72 feet to a point on
the westerly line of Crane Street; thence in a southerly direction and
along said westerly line of Crane Street, South 02°14'18" West, 68.50
feet to a point being the division line of the lands now or formerly of
Frank Leszczynski, Jr. and Zita Leszczynski (Book 1618, Page 459) on the
south and the lands herein described on the north; thence in a westerly,
southerly and easterly direction and along aforesaid division line the
following four courses: 1) South 86°51'49" West, 153.36 feet to a point;
2) South 12°46'42" East, 70.00 feet to a point; 3) North 78°27'18" East,
72.00 feet to a point and 4) North 79°19'18" East, 66.30 feet to a point
on the westerly line of Crane Street; thence in a southerly direction
and along said westerly line of Crane Street, South 02°14'18" West,
77.23 to the point or place of beginning.
Containing in all 2.03 acres of land being more or less.
§ 5. In the event that the parklands to be dedicated by the city of
Schenectady pursuant to this act are not equal to or greater than the
fair market value of the parkland to be discontinued and conveyed, the
city of Schenectady shall dedicate the difference of the fair market
value of the lands to be alienated and the lands to be dedicated for the
acquisition of additional parklands and/or for capital improvements to
existing park and recreational facilities.
§ 6. In the event that the city of Schenectady received any funding
support or assistance from the federal government for the purchase,
maintenance or improvement of the parklands set forth in section three
of this act, the discontinuance and alienation of such parkland author-

ized by the provisions of this act shall not occur until the city of
Schenectady has complied with any federal requirements pertaining to the
alienation or conversion of such parklands, including satisfying the
secretary of the interior that the alienation or conversion complies
with all conditions which the secretary of the interior deems necessary
to assure the substitution of other lands shall be equivalent in fair
market value and usefulness to the lands being alienated or converted.
§ 7. This act shall take effect immediately.
