 Introduced  by  Sen.  GOLDEN -- read twice and ordered printed, and when
   printed to be committed to the Committee on Children and Families
 
 AN ACT to amend the social services law, in relation to investigation of
   illegally operating child day care services
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subdivision 1 of section 390 of the social services law is
 amended by adding a new paragraph (g) to read as follows:
   (G) "INTERNET ADVERTISEMENT" SHALL MEAN ANY ADVERTISING  OR  PROMOTION
 OF CHILD DAY CARE SERVICES THROUGH THE MEDIUM OF INTERNET.
   §  2. Subdivisions 11, 12 and 13 of section 390 of the social services
 law, paragraph (b) of subdivision 12 as relettered by chapter 117 of the
 laws of 2010, are renumbered subdivisions 12, 13 and 14 and a new subdi-
 vision 11 is added to read as follows:
   11. (A) THE OFFICE OF CHILDREN AND FAMILY SERVICES SHALL  PERIODICALLY
 REVIEW,  NOT  LESS  THAN  ONCE A MONTH, INTERNET ADVERTISEMENTS OFFERING
 CHILD DAY CARE SERVICES. SUCH REVIEW SHALL INCLUDE  INTERNET  ADVERTISE-
 MENTS FROM EACH COUNTY IN THIS STATE.
   (B)  THE  OFFICE  OF CHILDREN AND FAMILY SERVICES SHALL, NO LATER THAN
 NINETY DAYS AFTER THE EFFECTIVE DATE OF THIS SUBDIVISION, ADOPT A PROCE-
 DURE FOR IMPLEMENTATION OF THIS SUBDIVISION, PROVIDED THAT  SUCH  PROCE-
 DURE INCLUDES IDENTIFICATION AND FURTHER INVESTIGATION OF PROVIDERS WHO:
   (I) ARE NOT REGISTERED OR LICENSED, AS REQUIRED BY THIS SECTION OR ANY
 REGULATIONS PROMULGATED THEREUNDER; AND
   (II) CANNOT PROVIDE THE CHILD DAY CARE SERVICES TO AN ADDITIONAL CHILD
 WITHOUT  VIOLATING  THIS  SECTION  OR ANY REGULATIONS PROMULGATED THERE-
 UNDER.
   § 3. This act shall take effect immediately.
