 AN ACT to authorize the city of Poughkeepsie, in the county of Dutchess,
   to discontinue the use of certain lands as parklands and to  sell  and
   convey such lands, which are no longer needed for park purposes
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act  but  notwithstanding
 any provision of general, special or local law to the contrary, the city
 of  Poughkeepsie, in the county of Dutchess is hereby authorized, acting
 by and through its Common Council and upon such terms and conditions  as
 determined by such legislative body, to discontinue the use of the muni-
 cipally  owned  parklands  and  alienate  the  lands  more  particularly
 described in section three of this act, and to use such property for the
 construction of a new drinking reservoir and to dedicate as parkland the
 lands upon which the former drinking water reservoir was constructed and
 lands encompassing the former open reservoir more particularly described
 in section four of this act.
   § 2. The authorization provided in section one of this  act  shall  be
 effective only upon the condition that the city of Poughkeepsie dedicate
 the  property  described  in section four of this act for the purpose of
 parklands and recreational purposes within the city.
   § 3. The land to  be  discontinued  as  parklands  and  alienated  and
 conveyed  by  the  city  of  Poughkeepsie  is  bounded  and described as
 follows:
   All that certain plot, piece or parcel of land lying and being in  the
 city of Poughkeepsie and the county of Dutchess in the state of New York
 and being more particularly described as follows:
   BEGINNING  at  a  point  in  the  northwesterly  bounds  of the herein
 described parcel, said point being S 52°57'21" E  567.32  ft.  from  the

 AN ACT to authorize the city of Poughkeepsie, in the county of Dutchess,
   to  discontinue  the use of certain lands as parklands and to sell and
   convey such lands, which are no longer needed for park purposes
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subject to the provisions of this act, the city of Pough-
 keepsie, in the county of Dutchess is hereby authorized, acting  by  and
 through  its Common Council and upon such terms and conditions as deter-
 mined by such legislative body, to discontinue the use of the municipal-
 ly owned parklands and alienate the lands more particularly described in
 section three of this act, and to use such property for the  purpose  of
 constructing and maintaining a new drinking water reservoir.
   §  2.  The  authorization provided in section one of this act shall be
 effective only upon the condition that the city  of  Poughkeepsie  dedi-
 cates  an  amount  equal to or greater than the fair market value of the
 parklands being discontinued towards the acquisition of additional park-
 lands and/or towards capital  improvements  to  existing  parklands  and
 recreational facilities.
   §  3.  The  land  to  be  discontinued  as parklands and alienated and
 conveyed by the  city  of  Poughkeepsie  is  bounded  and  described  as
 follows:
   All  that certain plot, piece or parcel of land lying and being in the
 city of Poughkeepsie and the county of Dutchess in the state of New York
 and being more particularly described as follows:
   BEGINNING at a  point  in  the  northwesterly  bounds  of  the  herein
 described  parcel,  said  point  being S 52°57'21" E 567.32 ft. from the
 intersection of  the  assumed  southeasterly  bounds  of  North  Clinton
