BILL NUMBER: S663 TITLE OF BILL : An act to amend the retirement and social security law, in relation to authorizing the commissioner of corrections and community supervision to approve a retired person's employment in a position in the department of corrections and community supervision PURPOSE OR GENERAL IDEA OF BILL : To allow retired correction officers to be employed and earn compensation in another position in the public service. SUMMARY OF SPECIFIC PROVISIONS : 1. Authorizes the commissioner of corrections and community supervision the authority to allow retired individuals to receive compensation in the public service. 2. Effective date. JUSTIFICATION : Currently, retired public employees must apply for a "211 Waiver" in order to earn more than $30,000 per year. This process, can often become burdensome. This bill would allow the department of corrections and community supervision to hire individuals without needing a "211

BOYLE -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the retirement and social security law, in relation to authorizing the commissioner of corrections and community supervision to approve a retired person's employment in a position in the depart- ment of corrections and community supervision THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 7 of paragraph (a) of subdivision 2 of section 211 of the retirement and social security law, as amended by chapter 840 of the laws of 1983, is amended and a new subparagraph 8 is added to read as follows: (7) the chief administrator of the courts if such person is to be employed in a judicial or nonjudicial position in the unified court system[.]; OR (8) THE COMMISSIONER OF CORRECTIONS AND COMMUNITY SUPERVISION IF SUCH PERSON IS TO BE EMPLOYED IN A POSITION IN THE SERVICE OF THE DEPARTMENT OF CORRECTIONS AND COMMUNITY SUPERVISION. § 2.
