BILL NUMBER: S6801 TITLE OF BILL : An act to amend the tax law, in relation to vendor fees for video lottery gaming; and providing for the repeal of such provisions upon expiration thereof PURPOSE : To adjust the administrative and capital rates of a vendor track located in Oneida County. SUMMARY OF PROVISIONS : Section 1: Subparagraph (i) of paragraph 1 of subdivision b of section 1612 of the tax law, as amended by chapter 174 of the laws of 2013, is amended to allow a gaming facility in Oneida County to withhold up to seventy five percent of the ten percent of total revenue wagered after payout for prizes for operational expenses. Section 2: Subparagraph (ii) of paragraph 1 of subdivision b of section 1612 13 of the tax law is amended by adding a new clause (J) is amended to allow a gaming facility in Oneida County to be eligible for a capital award up to four percent of total revenue wagered after payout of prizes for the purpose of capital or operational expenses.

BONACIC, GRIFFO, AKSHAR -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the tax law, in relation to vendor fees for video lottery gaming; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (i) of paragraph 1 of subdivision b of section 1612 of the tax law, as amended by chapter 174 of the laws of 2013, is amended to read as follows: (i) less ten percent of the total revenue wagered after payout for prizes to be retained by the division for operation, administration, and procurement purposes, PROVIDED HOWEVER, THAT A VENDOR TRACK LOCATED WITHIN ONEIDA COUNTY, WITHIN FIFTEEN MILES OF A NATIVE AMERICAN CLASS III GAMING FACILITY, AND MAINTAINING AT LEAST NINETY PERCENT OF FULL- TIME EQUIVALENT EMPLOYEES AS THEY EMPLOYED IN THE YEAR TWO THOUSAND SIXTEEN, AS DETERMINED BY THE GAMING COMMISSION SHALL BE ABLE TO WITH- HOLD UP TO SEVENTY-FIVE PERCENT OF SUCH FUNDS FOR OPERATIONAL EXPENSES; § 2. Subparagraph (ii) of paragraph 1 of subdivision b of section 1612 of the tax law is amended by adding a new clause (J) to read as follows: (J) NOTWITHSTANDING CLAUSE (H) OF THIS SUBPARAGRAPH, A VENDOR TRACK LOCATED WITHIN ONEIDA COUNTY, WITHIN FIFTEEN MILES OF A NATIVE AMERICAN CLASS III GAMING FACILITY, AND MAINTAINING AT LEAST NINETY PERCENT OF FULL-TIME EQUIVALENT EMPLOYEES AS THEY EMPLOYED IN THE YEAR TWO THOUSAND SIXTEEN, AS DETERMINED BY THE GAMING COMMISSION, SHALL BE ELIGIBLE FOR A VENDOR'S CAPITAL AWARD OF UP TO FOUR PERCENT OF THE TOTAL REVENUE WAGERED AT THE VENDOR TRACK AFTER PAYOUT FOR PRIZES PURSUANT TO THIS CHAPTER EACH YEAR, WHICH MAY BE USED FOR OPERATIONS OR CAPITAL INVEST- MENTS, IN SUCH VENDOR TRACK OPERATOR'S DISCRETION. § 3. This act shall take effect immediately and shall expire and be deemed repealed two years after such date.
