BILL NUMBER: S7308 SPONSOR: FUNKE TITLE OF BILL: An act to amend the state technology law, in relation to the state information technology innovation center PURPOSE: The purpose of this legislation is to allow for the development of a state information technology innovation center to facilitate the exam- ination and analysis of technology that would benefit New York State and its residents. SUMMARY OF PROVISIONS: This chapter amendment empowers the director to implement by guidelines rather than by regulation, the ability to carry out the provisions in the bill. This amendment also changes the date to January 2019, for when the director must submit a report to the speaker of the assembly, the

FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the state technology law, in relation to the state information technology innovation center THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 2 and 4 of section 103-a of the state technol- ogy law, as added by a chapter of the laws of 2017, amending the state technology law relating to the creation of a state information technolo- gy innovation center, as proposed in legislative bills numbers S. 1121-A and A. 1713-A, are amended to read as follows: 2. The director shall implement[, by regulation, procedures] GUIDE- LINES to carry out the provisions of this section WHICH SHALL NOT CONTRAVENE ANY PROVISION OF THE STATE FINANCE LAW. Such procedures shall include, but not be limited to: (a) establishing the process for selecting vendors for participation in the iCenter, which shall be a public process; (b) establishing a process to determine which technology needs or requirements shall be iCenter initiatives; and (c) establishing safeguards to ensure the iCenter does not function in a manner that results in the circumvention of competitive bidding, including but not limited to through single and sole source exemptions. 4. Every [October] JANUARY first, beginning in two thousand [eighteen] NINETEEN, the director shall submit a report to the speaker of the assembly, the temporary president of the senate, and the governor detailing iCenter initiatives undertaken in the prior year. Such report shall include but not be limited to: an identification of any STATE resources used to support the iCenter in the prior year; the number and nature of iCenter initiatives undertaken in the prior year; the identity of vendors that participated in the iCenter in the prior year, any iCen- ter initiatives piloted in the prior year that were subsequently awarded a procurement contract with any state agency[; any future initiatives being considered for inclusion in the iCenter] TO THE EXTENT THE OFFICE OF INFORMATION TECHNOLOGY SERVICES MAY BE AWARE OF SUCH CONTRACTS; and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
