BILL NUMBER: S7326 SPONSOR: HANNON TITLE OF BILL: An act to amend part E of chapter 57 of the laws of 2017 relating to the effective date of certain provisions thereof, as proposed in legislative bills numbers S. 5544 and A. 7216, in relation to the effectiveness thereof PURPOSE: To clarify the intended effective date for fiscal intermediaries in the consumer directed personal assistance program to be authorized by the Department of Health should be January 1, 2018 and allow entities oper- ating as fiscal intermediaries prior to April 1, 2017 to have a year to obtain such authorization. SUMMARY OF PROVISIONS: Section 1 of the bill amends section 7 of Part E of S.2007B/A3007B to provide a January 1, 2018 effective date and allow entities who were already fiscal intermediaries a year to become authorized fiscal inter-

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend part E of chapter 57 of the laws of 2017 relating to the effective date of certain provisions thereof, as proposed in legisla- tive bills numbers S. 5544 and A. 7216, in relation to the effective- ness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 7 of part E of chapter 57 of the laws of 2017, amending the social services law relating to fiscal intermediary certif- ication under the consumer directed personal assistance program, as amended by a chapter of the laws of 2017, amending part E of chapter 57 of the laws of 2017 relating to the effective date of certain provisions thereof, as proposed in legislative bills numbers S. 5544 and A. 7216, is amended to read as follows: § 7. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 1, 2017; except that section one of this act shall take effect on the first of January after it shall have become a law; provided that prior to that date, the commissioner of health shall [make regulations and] take [other] actions reasonably necessary to implement subdivisions 4-a and 4-b of section 365-f of the social services law, as added by section one of this act, on that date; and provided further that any entity operating as a fiscal intermediary prior to this act becoming a law may continue to do so [for one year after this act takes effect] UNTIL JANUARY 31, 2018, and may continue to do so after that time only upon obtaining authorization under this act. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2017, amending part E of chapter 57 of the laws of 2017 relating to the effective date of certain provisions thereof, as proposed in legislative bills numbers S. 5544 and A. 7216, takes effect.
