BILL NUMBER: S7332 SPONSOR: PERALTA TITLE OF BILL: An act to amend chapter 450 of the laws of 2017, authorizing the city of New York to discontinue certain parkland for the purpose of construction and operation of a pre-kindergarten center with a focus on instruction in science, technology, engineering, and math- ematics, in relation to the reversion of such lands back to the city of New York if such land is not used for such purpose PURPOSE: The bill will clarify if such property which is defined by metes and bounds in the underlying chapter, prior to the construction of any pre- kindergarten center buildings, is used for a purpose inconsistent with the purposes of chapter 734 of the laws of 1963 (Hall of Science), such property shall revert back to the city of New York for purposes consist- ent with those provided by such chapter. In the event any pre-K center buildings have been erected on such described property and such property is used for a purpose other than for such educational purpose, such property shall revert back to the city of New York department of parks and recreation to be used for park and recreational purposes or for the

PERALTA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 450 of the laws of 2017, authorizing the city of New York to discontinue certain parkland for the purpose of construction and operation of a pre-kindergarten center with a focus on instruction in science, technology, engineering, and mathematics, in relation to the reversion of such lands back to the city of New York if such land is not used for such purpose THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 5 of chapter 450 of the laws of 2017, authorizing the city of New York to discontinue certain parkland for the purpose of construction and operation of a pre-kindergarten center with a focus on instruction in science, technology, engineering, and mathematics, is amended to read as follows: § 5. [If] IN THE EVENT, PRIOR TO THE CONSTRUCTION OF ANY PRE-KINDER- GARTEN CENTER BUILDINGS, THE PROPERTY DESCRIBED IN SECTION THREE OF THIS ACT SHALL BE USED FOR A PURPOSE THAT IS INCONSISTENT WITH THE PURPOSES OF CHAPTER 734 OF THE LAWS OF 1963, SUCH PROPERTY SHALL REVERT BACK TO THE CITY OF NEW YORK FOR PURPOSES THAT ARE CONSISTENT WITH THOSE PROVIDED BY CHAPTER 734 OF THE LAWS OF 1963. IN THE EVENT ANY PRE-KIN- DERGARTEN CENTER BUILDINGS HAVE BEEN ERECTED ON THE PROPERTY DESCRIBED IN SECTION THREE OF THIS ACT AND IF the property described in section three of this act shall ever be used for a purpose other than for the purpose described in section one of this act, such property shall revert back to the city of New York department of parks and recreation to be used for park and recreational purposes or for the purposes provided by chapter 734 of the laws of 1963, including any amendments made thereto. § 2. Section 3 of chapter 450 of the laws of 2017, authorizing the city of New York to discontinue certain parkland for the purpose of construction and operation of a pre-kindergarten center with a focus on instruction in science, technology, engineering, and mathematics, is amended to read as follows: § 3. The lands authorized to be discontinued pursuant to section one of this act are as follows: [A parcel of land lying in Queens, New York, in Tax Block No. 2018 Lot 1, more particularly described as follows; BEGINNING at a point from the corner formed by the intersection of the westerly line of 111th Street and the southerly line of 46th Avenue. From said point, running easterly 95.51 feet along the projected south- erly line of 46th Avenue to a point, thence running southerly 12.80 feet parallel to the west line of 111th Street to a point or place of begin- ning; 1. Running thence easterly 229.20 feet, forming an interior angle of 271.16 degrees, to a point, thence; 2. Running southerly 186.50 feet, forming an interior angle of 90.00 degrees, to a point of curvature, thence; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
