TITLE OF BILL:  An act to amend the agriculture and markets law, in
relation to developing a beekeeper registry program

 
PURPOSE:

To maintain a census of beekeepers and beehives with the goal of
protecting the health and wellbeing of bees.

 
SUMMARY OF PROVISIONS:

Section 1: Adds a new subdivision 5 to section 169-d of the Agriculture
and Markets Law authorizing the Department of Agriculture and Markets to
create a beekeeper registry which could be maintained by a university
with expertise in bee health. If such a registry were created, busi-
nesses selling bees and beekeeping equipment would be required to
provide their customers with information about the program and how to
register.

Section 2: Establishes effective date

 
JUSTIFICATION:

Commercial and hobby beekeepers are facing immense challenges when
trying to keep their hives alive and healthy. According to Cornell
University, among the challenges facing beekeepers are mites which may
cause diseases that are dramatically weakening hives. The incidence of
mites and the viruses has reached an epidemic level. It is recognized
that only a small percentage of beekeepers are known to the State.
Emerging science is pointing to the mite and virus issue expanding
beyond the beehives. The need to control this epidemic and conduct
research and communicate with beekeepers requires the involvement of
every beekeeper in the State. This bill would have the Commissioner and
the Department's Apiary Advisory Committee develop a program that will
get buy-in from beekeepers to maximize participation in the registry and
work with Cornell to provide needed tracking and communication to beek-
eepers and in return get valuable information to improve research and
prevention.

 AN ACT to amend the agriculture and markets law, in relation to develop-
   ing a beekeeper registry program
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Section  169-d  of  the  agricultural  and markets law is
 amended by adding a new subdivision 5 to read as follows:
   5. (A) APIARY INDUSTRY REGISTRY. THE COMMISSIONER, IN COOPERATION WITH
 THE APIARY INDUSTRY ADVISORY COMMITTEE, IS AUTHORIZED TO DEVELOP A BEEK-
 EEPER REGISTRY PROGRAM FOR COMMERCIAL BEEKEEPERS,  PART-TIME  BEEKEEPERS
 AND  HOBBYIST  BEEKEEPERS. SUCH PROGRAM MAY BE MANAGED BY AN INSTITUTION
 OF HIGHER EDUCATION WITH EXPERTISE IN BEEKEEPING  AND  BEE  HEALTH.  THE
 PURPOSE  OF SUCH REGISTRY PROGRAM SHALL BE TO MAINTAIN A CENSUS OF BEEK-
 EEPERS AND BEEHIVES AND PROVIDE A MEANS OF  COMMUNICATION  TO  AND  FROM
 BEEKEEPERS  AND  BEE  RESEARCH PROGRAMS TO PROVIDE FOR MONITORING OF THE
 BEE POPULATION IN NEW YORK STATE WITH THE GOAL OF PROTECTING THE  HEALTH
 AND WELLBEING OF BEES, PREVENTING DISEASE AND MAINTAINING THE PRODUCTIV-
 ITY OF BEES FOR POLLINATION AND HONEY PRODUCTION.
   (B) REGISTRY NOTIFICATION BY SELLERS OF BEES AND BEEKEEPING EQUIPMENT.
 AS  PART  OF  A  BEEKEEPER  REGISTRY  PROGRAM DEVELOPED PURSUANT TO THIS
 SUBDIVISION, ANY PERSON, FIRM, LIMITED LIABILITY COMPANY OR  CORPORATION
 THAT  SELLS  BEES  AND  BEEKEEPING EQUIPMENT TO NEW YORK STATE RESIDENTS
 SHALL PROVIDE INFORMATION REQUIRED BY THE DEPARTMENT TO NEW  YORK  STATE
 PURCHASERS OF SUCH BEES OR BEEKEEPING EQUIPMENT INFORMING THEM ABOUT THE
 BEEKEEPER  REGISTRY  PROGRAM, INCLUDING, BUT NOT LIMITED TO, THE PURPOSE
 OF SUCH PROGRAM AND HOW SUCH PURCHASERS MAY REGISTER.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such date.
