BILL NUMBER: S8596 SPONSOR: AMEDORE TITLE OF BILL: An act to amend the environmental conservation law, in relation to the powers and duties of the Albany Pine Bush commission PURPOSE: The purpose of this bill is to allow the Albany Pine Bush Preserve Commission (Commission) to acquire real property in the name of the State to carry out the purposes and functions of the Commission. (Department of Environmental Conservation Program Bill #148) SUMMARY OF PROVISIONS: Section 1 of the bill amends section 46-0107 of the Environmental Conservation Law (ECL) by adding a new subdivision 6 establishing that any real property acquired by the Commission is automatically dedicated to the Albany Pine Bush Preserve.

AMEDORE -- (at request of the Department of Environ- mental Conservation) -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the powers and duties of the Albany Pine Bush commission THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 46-0107 of the environmental conservation law is amended by adding a new subdivision 6 to read as follows: 6. LAND OWNED BY THE COMMISSION SHALL BE DEDICATED TO BE PART OF THE PRESERVE UPON ACQUISITION BY THE COMMISSION. § 2. Section 46-0109 of the environmental conservation law is amended by adding a new subdivision 19 to read as follows: 19. TO ACQUIRE REAL PROPERTY AS MAY BE NECESSARY FOR THE PURPOSES AND FUNCTIONS OF THE COMMISSION. SUCH REAL PROPERTY MAY BE ACQUIRED IN THE NAME OF THE COMMISSION BY PURCHASE, EXCHANGE, GIFT, DEVISE, BEQUEST, OR BY OTHER LEGAL MEANS. § 3. This act shall take effect immediately.
