 AN ACT to authorize the town of Brookhaven, county of Suffolk, to alien-
   ate certain parklands and to dedicate other lands as parklands
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act, the town of Brookha-
 ven, county of Suffolk, is hereby authorized to discontinue and alienate
 as parklands the lands described in section three of this act.
   §  2.  The  authorization provided in section one of this act shall be
 effective only upon the condition that the town of  Brookhaven  dedicate
 the lands described in section four of this act as parklands.
   §  3. The parklands authorized by section one of this act to be alien-
 ated as parklands is described as follows:
 
                                Parcel One
 
 Property   identified    as    Suffolk    County    Tax    Map    Number
 0200-615.00-04.00-005.000; .42 acres
 
                                Parcel Two
 
 Property    identified    as    Suffolk    County    Tax    Map   Number
 0200-615.00-04.00-006.000; .5 acres
   § 4. Prior to the  discontinuance  and  alienation  of  the  parklands
 described  in  section  three  of this act, the town of Brookhaven shall
 dedicate as parklands such land described as follows:
 Property located at 313 Frowein Road in the Hamlet  of  Center  Moriches
 and     identified     as     Suffolk     County    Tax    Map    Number
 0200-827.00-02.00-006.000; 6.3 acres

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act, the town of Brookha-
 ven, county of Suffolk, is hereby authorized to discontinue and alienate
 as parklands the lands described in section three of this act.
   §  2.  The  authorization provided in section one of this act shall be
 effective only upon the condition that the town of  Brookhaven  dedicate
 the lands described in section four of this act as parklands.
   §  3. The parklands authorized by section one of this act to be alien-
 ated as parklands is described as follows:
 
                                Parcel One
 
   ALL that certain plot, piece or parcel of  land,  situate,  lying  and
 being  in  the  Town  of  Brookhaven, County of Suffolk and State of New
 York, known and designated as Lot Number 78 on a certain  map  entitled,
 "Map  of Shirley, Long Island, Unit A", filed in the Office of the Clerk
 of the County of Suffolk on December 28, 1949 as Map number 1725,  which
 said lot is bounded and described as follows:
   BEGINNING  at  a  point on the Westerly side of Carnation Drive at the
 extreme Southerly end of a curve with a radius of 30.00 feet, which said
 curve connects the Westerly side of Carnation Drive  and  the  Southerly
 side of Carleton Drive;

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  Subject to the provisions of this act, the town of  Brook-
 haven,  county  of Suffolk, acting by and through its governing body and
 upon such terms and conditions as determined by  such  body,  is  hereby
 authorized  to  discontinue  as  parklands  and  to  alienate  the lands
 described in section three of this act to DiPaolo Development, LLC to be
 used for residential purposes.
   § 2. The authorization provided in section one of this  act  shall  be
 effective  only  upon the condition that the town of Brookhaven dedicate
 the lands described in section four of this  act  as  parkland  provided
 that  the  town  of Brookhaven has never used such lands for public open
 space or park purposes.
   § 3. The parklands authorized by section one of this act to be  alien-
 ated as parklands are described as follows:

 being in the Town of Brookhaven, County of  Suffolk  and  State  of  New
