BILL NUMBER: S8795 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the executive law, in relation to dialysis center disaster preparedness plans PURPOSE: This legislation would require nursing homes, assisted living centers and dialysis centers to have emergency generators sufficient to supply electrical power in the event of an emergency. SUMMARY OF PROVISIONS: The state executive law Section 23-b is amended to require nursing homes, assisted living residences and dialysis centers to have genera- tors available as part of their disaster preparedness plans. SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT to amend the executive law, in relation to dialysis center disas- ter preparedness plans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 23-d to read as follows: § 23-D. FACILITIES OFFERING DIALYSIS SERVICES. ALL FACILITIES OFFERING DIALYSIS SERVICES SHALL HAVE AN ALTERNATE GENERATED POWER SOURCE. FOR THE PURPOSES OF THIS SECTION "ALTERNATE GENERATED POWER SOURCE" MEANS ELECTRIC GENERATING EQUIPMENT THAT IS OF A CAPACITY THAT IS CAPABLE OF PROVIDING ADEQUATE ELECTRICITY TO OPERATE ALL EQUIPMENT NECESSARY TO PROVIDE INDIVIDUALS WITH DIALYSIS SERVICES WHICH CAN OPERATE INDEPENDENT OF THE LOCAL ELECTRIC UTILITY DISTRIBUTION SYSTEM AND PROVIDE ELECTRIC- ITY DURING A GENERAL POWER OUTAGE OR DISASTER EMERGENCY DECLARED PURSU- ANT TO SECTION TWENTY-EIGHT OF THIS ARTICLE. § 2.
