BILL NUMBER: S8878 SPONSOR: LAVALLE TITLE OF BILL: An act in relation to certain examinations taken by funeral directors PURPOSE: This bill seeks to ensure that licensed funeral directors whose careers are threatened due to non-renewal of their registrations as of June 30, 2018, will be able to continue practicing funeral directing without interruption unless the New York State Department Health (DOH) deter- mines, after notice and an agency hearing, that the licensee did indeed commit misconduct with respect to obtaining their license or in admis- sion to practice funeral directing. SUMMARY OF PROVISIONS: Section 1. LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT in relation to certain examinations taken by funeral directors THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other law, rule, order or regulation to the contrary, a funeral director duly licensed pursuant to article 34 of the public health law at the time of application for the 2018-2020 bien- nial renewal registration or any registration thereafter shall be presumed to have successfully passed all required examinations notwith- standing any adverse action with regard to examination scores that occurred after the initial application for licensure had been approved unless the commissioner of health shall have determined, after providing the applicant due notice and an opportunity to be heard, that the appli- cant is in violation of paragraph (c) of subdivision 1 of section 3450 of the public health law. § 2.
