 Introduced  by  Sen.  DeFRANCISCO -- read twice and ordered printed, and
   when printed to be committed to the Committee on Rules
 
 AN ACT to amend the executive law, in relation to  the  compensation  of
   staff of the executive department
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 30 of the executive  law  is  amended  to  read  as
 follows:
   § 30. Executive  department.   There shall continue to be in the state
 government an executive department. The head of the executive department
 shall be the governor. The governor may appoint  such  subordinates  and
 employees  as may be necessary for the exercise of his OR HER powers and
 the performance of his OR HER duties as head of  the  executive  depart-
 ment,  and  may prescribe their duties and fix their compensation within
 the amounts appropriated therefor. PROVIDED HOWEVER, THAT  THE  SALARIES
 AND  OTHER  COMPENSATION  OF EMPLOYEES IN THE EXECUTIVE CHAMBER SHALL BE
 APPROPRIATED EXCLUSIVELY IN THE BUDGET OF THE EXECUTIVE CHAMBER AND THAT
 THE FUNCTION AND DUTIES OF EMPLOYEES IN OTHER EXECUTIVE DEPARTMENT DIVI-
 SIONS AS DEFINED IN SECTION THIRTY-ONE  OF  THIS  ARTICLE,  OTHER  STATE
 AGENCIES, DEPARTMENTS, PUBLIC AUTHORITIES AND OTHER STATE ENTITIES SHALL
 BE  RELATED  TO  THE  MISSION  AND JOB ACTIVITIES OF THE AGENCY IN WHICH
 THEIR SALARY AND OTHER COMPENSATION COSTS ARE APPROPRIATED.
   § 2. This act shall take effect immediately.
