 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   prohibiting the use of certain grades of fuel oil
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The environmental conservation law is amended by  adding  a
 new section 19-0329 to read as follows:
 § 19-0329. CERTAIN FUEL OIL; PROHIBITED.
   1. ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY-THREE, NO FUEL OIL,
 GRADE  NUMBER SIX, AS CLASSIFIED BY AMERICAN SOCIETY FOR TESTING MATERI-
 ALS STANDARD D396-15C, SHALL BE USED IN ANY BUILDING OR  FACILITY  OWNED
 OR OPERATED BY THE STATE, OR ANY AGENCY THEREOF.
   2. ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY-EIGHT, NO FUEL OIL,
 GRADE NUMBER FOUR, AS CLASSIFIED BY AMERICAN SOCIETY FOR TESTING MATERI-
 ALS  STANDARD  D396-15C, SHALL BE USED IN ANY BUILDING OR FACILITY OWNED
 OR OPERATED BY THE STATE, OR ANY AGENCY THEREOF.
   § 2. This act shall take effect immediately.

 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   prohibiting the use of certain heating oils in state, county and local
   government owned buildings
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The environmental conservation law is amended by adding a
 new section 19-0329 to read as follows:
 § 19-0329. HEATING OIL REQUIREMENTS FOR GOVERNMENT OWNED BUILDINGS.
   (1) DEFINITIONS. FOR THE PURPOSE OF THIS SECTION, THE FOLLOWING  TERMS
 SHALL HAVE THE FOLLOWING MEANINGS:
   (A) "HEATING OIL" MEANS OIL REFINED FOR THE PURPOSE OF USE AS FUEL FOR
 COMBUSTION IN A HEATING SYSTEM AND THAT MEETS THE SPECIFICATIONS OF ASTM
 DESIGNATION  D  396-12  OR  OTHER  SPECIFICATIONS  AS  DETERMINED BY THE
 COMMISSION.
   (B) "HEATING SYSTEM" MEANS A SYSTEM THAT GENERATES HEAT, HOT AIR,  HOT
 WATER  OR  STEAM  BY  COMBUSTION  AND  DISTRIBUTES IT WITHIN A BUILDING,
 PROVIDED THAT "HEATING SYSTEM" SHALL NOT INCLUDE WOOD BURNING STOVES.
   (2)(A) NO PERSON SHALL CAUSE OR PERMIT THE USE IN ANY STATE, COUNTY OR
 LOCAL GOVERNMENT OWNED BUILDING OR DELIVERY  TO  ANY  STATE,  COUNTY  OR
 LOCAL  GOVERNMENT  OWNED  BUILDING FOR USE IN SUCH BUILDING, HEATING OIL
 THAT IS FUEL OIL GRADE NO. 6 IN AN AMOUNT:
   (I) GREATER THAN EIGHTY PERCENT OF THE HEATING OIL FOR SUCH  BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND NINETEEN;
   (II)  GREATER THAN SIXTY PERCENT OF THE HEATING OIL FOR SUCH BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY;
   (III) GREATER THAN FORTY PERCENT OF THE HEATING OIL FOR SUCH BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-ONE; AND
   (IV) GREATER THAN TWENTY PERCENT OF THE HEATING OIL FOR SUCH BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-TWO.

 GRADE NUMBER FOUR, AS CLASSIFIED BY AMERICAN SOCIETY FOR TESTING MATERI-
 ALS  STANDARD  D396-15C, SHALL BE USED IN ANY BUILDING OR FACILITY OWNED
 OR OPERATED BY THE STATE, OR ANY AGENCY THEREOF.
   3. NOTHING IN THIS SECTION SHALL PREVENT A MUNICIPALITY FROM  ADOPTING
 A  LAW,  CODE,  ORDINANCE OR REGULATION WHICH IS MORE STRINGENT THAN THE
 REQUIREMENTS OF THIS SECTION WITH RESPECT TO FUEL OIL GRADE NUMBER  FOUR
 AND FUEL OIL GRADE NUMBER SIX.
   § 2. This act shall take effect immediately.
