S T A T E O F N E W Y O R K ________________________________________________________________________ 8222 2019-2020 Regular Sessions I N A S S E M B L Y June 7, 2019 ___________ Introduced by M. of A. PALMESANO -- read once and referred to the Committee on Local Governments AN ACT to amend the village law and the public officers law, in relation to authorizing the village of Riverside to hire a village clerk/treasurer and code enforcement officer who is not a resident of such village THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3-300 of the village law is amended by adding a new subdivision 29 to read as follows: 29. NOTWITHSTANDING ANY PROVISIONS OF THIS CHAPTER OR ANY OTHER GENER- AL LAW, LOCAL LAW, ORDINANCE, OR SPECIAL ACT, THE VILLAGE BOARD OF TRUS- TEES OF THE INCORPORATED VILLAGE OF RIVERSIDE, STEUBEN COUNTY, MAY, BY RESOLUTION, PROVIDE THAT THE VILLAGE CLERK/TREASURER AND CODE ENFORCE- MENT OFFICER OF THE VILLAGE OF RIVERSIDE, STEUBEN COUNTY, NEED NOT BE A RESIDENT OF SUCH VILLAGE, BUT MUST BE A RESIDENT OF THE COUNTY IN WHICH SUCH VILLAGE IS LOCATED OR AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK. § 2. Section 3 of the public officers law is amended by adding a new subdivision 68 to read as follows: 68. IN THE VILLAGE OF RIVERSIDE, IN THE COUNTY OF STEUBEN, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF VILLAGE CLERK/TREASURER AND CODE ENFORCEMENT OFFICER OF THE VILLAGE OF RIVERSIDE, PROVIDED THAT SUCH PERSON RESIDES IN THE COUNTY IN WHICH SUCH VILLAGE IS LOCATED OR AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK. PROVIDED, HOWEVER, THE PERSON PERFORMING THE FUNCTIONS OF VILLAGE CLERK/TREASURER AND CODE ENFORCEMENT OFFICER IN ANY OTHER VILLAGE SHALL BE A RESIDENT OF SUCH VILLAGE, UNLESS OTHERWISE PROVIDED BY AN ACT OF THE STATE LEGISLATURE. § 3. This act shall take effect immediately.
