BILL NUMBER: S1640 SPONSOR: BROOKS TITLE OF BILL: An act to amend the navigation law, in relation to requiring working marine carbon monoxide detectors to be carried on certain boats PURPOSE: The purpose of this bill is to prospectively require that carbon monox- ide detectors be installed onboard any boat that includes a cabin before its sale. SUMMARY OF PROVISIONS: Section 1. amends section 40 of the navigation law by creating a new subdivision 9-a which provides a requirement that new vessels for sale include a carbon monoxide detector. This section only applies to vessels that include an enclosed sleeping accommodation, galley with sink, or head compartment. This section further includes old vessels for sale

BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the navigation law, in relation to requiring working marine carbon monoxide detectors to be carried on certain boats THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 40 of the navigation law is amended by adding a new subdivision 9-a to read as follows: 9-A. MARINE CARBON MONOXIDE DETECTORS. (A) FOR THE PURPOSES OF THIS SECTION, A MARINE CARBON MONOXIDE DETECTION SYSTEM SHALL MEAN A DEVICE OR SYSTEM THAT MEETS THE REQUIRE- MENTS OF THE CURRENT VERSION OF THE AMERICAN BOAT AND YACHT COUNCIL STANDARD A-24, FOR CARBON MONOXIDE DETECTION SYSTEMS. (B) FOR THE PURPOSE OF THIS SECTION, AN "ENCLOSED ACCOMMODATION COMPARTMENT" MEANS ONE CONTIGUOUS SPACE, SURROUNDED BY BOAT STRUCTURE THAT CONTAINS ALL OF THE FOLLOWING: (I) DESIGNATED SLEEPING ACCOMMODATIONS; (II) A GALLEY AREA WITH SINK; AND (III) A HEAD COMPARTMENT. (C) FOR THE PURPOSES OF THIS SECTION, "SUBSTANTIAL RENOVATIONS" SHALL MEAN ANY RENOVATION WHERE THE VALUE OF RENOVATION WORK IS EQUAL TO OR GREATER THAN THE PRESENT MARKET VALUE OF THE VESSEL. (D) AFTER THE EFFECTIVE DATE OF THIS SUBDIVISION, NO NEW VESSEL THAT HAS AN ENCLOSED ACCOMMODATION COMPARTMENT OR A VESSEL THAT UNDERGOES SUBSTANTIAL RENOVATIONS MAY BE SOLD OR OFFERED FOR SALE IN THE STATE UNLESS SUCH VESSEL IS EQUIPPED WITH A NEW FUNCTIONING MARINE CARBON MONOXIDE DETECTION SYSTEM INSTALLED ACCORDING TO THE MANUFACTURER'S INSTRUCTIONS. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
