BILL NUMBER: S1797 SPONSOR: RIVERA TITLE OF BILL: An act to amend the education law, in relation to the employment and supervision of physician assistants PURPOSE: To clarify that the limitation on the number of physician assistants that may be supervised by a particular physician is specifically at any one time. SUMMARY OF PROVISIONS: This bill amends Education Law § 6542 to delete the limitation on the number of physician assistants (PAs) who may be employed by a particular physician, and clarify that the limitations on supervision is specif- ically related to any one time.

RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to the employment and supervision of physician assistants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 5 of section 6542 of the education law, as amended by section 1 of part T of chapter 57 of the laws of 2013, are amended and a new subdivision 8 is added to read as follows: 3. No physician shall [employ or] supervise more than four physician assistants AT ANY ONE TIME in his or her private practice. 5. Notwithstanding any other provision of this article, nothing shall prohibit a physician employed by or rendering services to the department of corrections and community supervision under contract from supervising no more than six physician assistants AT ANY ONE TIME in his or her practice for the department of corrections and community supervision. 8. NOTHING IN SUBDIVISION THREE OR FIVE OF THIS SECTION SHALL BE CONSTRUED TO MODIFY THE CONDITIONS RELATING TO THE PERFORMANCE OF MEDICAL SERVICES REQUIRED UNDER SUBDIVISION ONE OF THIS SECTION. § 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law. Effective immediately, any rules and regulations necessary to implement the provisions of this act on its effective date are authorized to be added, amended and/or repealed on or before such date.
