BILL NUMBER: S4247 SPONSOR: RANZENHOFER TITLE OF BILL: An act to amend the tax law, in relation to the allo- cation and distribution of taxes owed in Genesee county PURPOSE: This legislation, if enacted, would allow the County of Genesee and the City of Batavia to enter into an agreement whereby the County could enter into an agreement as to the division of its sales tax revenue to the City of Batavia for a term not to exceed forty years. JUSTIFICATION: Based on a discussion with the Comptroller's office, the County and the City have been informed that historically, the Comptroller does not approve contracts of this nature that are longer than ten years in dura- tion. These contracts, as a general rule, are normally five years in duration.

RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the tax law, in relation to the allocation and distrib- ution of taxes owed in Genesee county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The tax law is amended by adding a new section 1262-u to read as follows: § 1262-U. ALLOCATION AND DISTRIBUTION OF CERTAIN NET COLLECTIONS IN GENESEE COUNTY. IF THE COUNTY OF GENESEE ENTERS INTO AN AGREEMENT PURSU- ANT TO THE AUTHORITY OF SUBDIVISION (C) OF SECTION TWELVE HUNDRED SIXTY-TWO OF THIS PART WITH THE CITY OF BATAVIA TO ALLOCATE AND DISTRIB- UTE A PORTION OF NET COLLECTIONS DUE THE COUNTY FROM ITS TAXES IMPOSED PURSUANT TO THE AUTHORITY OF SUBDIVISION (A) OF SECTION TWELVE HUNDRED TEN OF THIS ARTICLE, THE AGREEMENT MAY BE FOR A TERM NOT EXCEEDING FORTY YEARS AND THE STATE COMPTROLLER SHALL NOT DISAPPROVE SUCH AGREEMENT BASED ON THE LENGTH OF ITS TERM, PROVIDED THAT SUCH TERM SHALL NOT EXCEED FORTY YEARS. § 2.
