BILL NUMBER: S4442 SPONSOR: GIANARIS TITLE OF BILL: An act to amend the executive law, in relation to requiring the division of criminal justice services and the division of state police to publish quarterly reports providing information related to firearms used in the commission of crimes in the state of New York PURPOSE: To inform policymakers and the public of the origin of guns used to commit crimes. SUMMARY OF PROVISIONS: Section 1 amends the Executive law, adding a new section 837-t, requir- ing the state division of criminal justice services in conjunction with the division of state police to publish quarterly reports detailing the origin of guns used in crimes in New York.

GIANARIS, ADDABBO, BAILEY, BROOKS, CARLUCCI, COMRIE, MAYER, SEPULVEDA, STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to requiring the division of criminal justice services and the division of state police to publish quarterly reports providing information related to firearms used in the commission of crimes in the state of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 837-t to read as follows: § 837-T. REPORTING ON FIREARMS USED IN THE COMMISSION OF A CRIME. 1. THE DIVISION, IN CONJUNCTION WITH THE DIVISION OF STATE POLICE, SHALL PUBLISH QUARTERLY REPORTS ON THEIR RESPECTIVE WEBSITES BEGINNING OCTOBER FIRST, TWO THOUSAND NINETEEN, WITH INFORMATION RELATED TO FIREARMS USED IN THE COMMISSION OF CRIMES IN THE STATE OF NEW YORK, INCLUDING BUT NOT LIMITED TO, THE COUNTY AND STATE OF ORIGIN OF THE FIREARM, THE COUNTY AND STATE WHERE THE FIREARM WAS PURCHASED, WHETHER THE FIREARM WAS PURCHASED BY THE PERPETRATOR OF THE CRIME OR BY ANOTHER INDIVIDUAL, AND WHETHER THE PERPETRATOR HAD A LICENSE TO POSSESS SUCH FIREARM. 2. EACH POLITICAL SUBDIVISION, MUNICIPALITY, COMMISSION, AGENCY, OFFICE, DEPARTMENT, BOARD AND DIVISION IN THE STATE, TO THE EXTENT NOT INCONSISTENT WITH OTHER PROVISIONS OF LAW, SHALL COOPERATE FULLY WITH THE DIVISION AND SHALL FURNISH THE DIVISION WITH INFORMATION AND ASSIST- ANCE AS MAY BE REQUIRED IN THE PERFORMANCE OF ITS FUNCTION UNDER THIS SECTION. § 2. SUMMARY OF PROVISIONS: Section 1 amends the Executive law, adding a new section 837-t, requir- ing the state division of criminal justice services in conjunction with the division of state police to publish quarterly reports detailing the origin of guns used in crimes in New York. JUSTIFICATION: New York has some of the toughest gun laws in the country. There is evidence that in states with tough gun laws, most guns used in the commission of crimes were acquired in states with weaker gun laws. This bill would require that the state release data on this matter. Doing so
