BILL NUMBER: S4637 SPONSOR: MONTGOMERY TITLE OF BILL: An act to amend the public health law, in relation to providing information on possible complications from pregnancy; and in relation to screenings and referrals for serious threats to life after pregnancy PURPOSE: To ensure that the Department of Health is taking steps to lower the State's maternal mortality rate by ensuring that pregnant women and new mothers receive information on complications that could lead to death. SUMMARY OF PROVISIONS: Section 1 amends § 2803of the Public Health Law to mandate that leaflets provided to maternity patients include information about serious compli- cations that could lead to death. The commissioner shall consult with any official boards mandated to review an investigate maternal mortality to ensure that information is correct and up to date.

MONTGOMERY -- read twice and ordered printed, and when printed to be committed to the Committee on Women's Issues AN ACT to amend the public health law, in relation to providing informa- tion on possible complications from pregnancy; and in relation to screenings and referrals for serious threats to life after pregnancy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1-b of section 2803-j of the public health law, as amended by chapter 199 of the laws of 2014, is amended to read as follows: 1-b. The informational leaflet shall also include information relating to the physical and mental health of the maternity patient after discharge from the hospital, including, but not limited to, information about maternal depression AND INFORMATION ON POSSIBLE COMPLICATIONS FROM PREGNANCY THAT CAN LEAD TO DEATH. The commissioner, in collaboration with the commissioner of mental health, shall review and update the information on maternal depression contained in the leaflet, as neces- sary. THE COMMISSIONER, IN CONSULTATION WITH OFFICIAL BOARDS IN THE STATE RESPONSIBLE FOR REVIEWING AND INVESTIGATING CAUSES OF MATERNAL MORTALITY, SHALL REVIEW AND UPDATE THE INFORMATION ON POSSIBLE COMPLI- CATIONS FROM PREGNANCY THAT CAN LEAD TO DEATH, AS NECESSARY. The infor- mational leaflets shall be made available to patients in the top six languages spoken in the state, other than English, according to the latest available data from the United States Census Bureau. § 2. Paragraph (b) of subdivision 1 of section 2803-n of the public health law, as amended by chapter 199 of the laws of 2014, is amended to read as follows: (b) Maternity care shall also include, at minimum, parent education, assistance and training in breast or bottle feeding, education on mater- nal depression, education on maternal depression screening and refer- rals, INCLUDING SCREENINGS AND REFERRALS TO IDENTIFY CONDITIONS IDENTI- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

Section 2803-j of the public health law is amended by adding a new subdivision 1-e to read as follows: 1-E. THE INFORMATIONAL LEAFLET SHALL ALSO INCLUDE INFORMATION ON POSSIBLE COMPLICATIONS FROM PREGNANCY THAT CAN ENDANGER THE LIFE OR HEALTH OF THE NEWBORN OR THE MOTHER. THE COMMISSIONER, IN CONSULTATION WITH ANY STATE OR LOCAL GOVERNMENT MATERNAL MORTALITY REVIEW BOARDS, SHALL REVIEW AND UPDATE THIS INFORMATION AS NECESSARY. § 2. Paragraph (b) of subdivision 1 of section 2803-n of the public health law, as amended by chapter 199 of the laws of 2014, is amended to read as follows: (b) Maternity care shall also include, at minimum, parent education, assistance and training in breast or bottle feeding, education on mater- nal depression, education on maternal depression screening and refer- rals, and the performance of any necessary OR APPROPRIATE maternal and newborn clinical assessments AND SCREENINGS AND APPROPRIATE REFERRALS. Notwithstanding this requirement, nothing in this paragraph is intended to result in the hospital charging any amount for such services in addi- tion to the applicable charge for the maternity inpatient hospital admission. § 3. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
