BILL NUMBER: S4990 SPONSOR: BIAGGI TITLE OF BILL: An act to amend the social services law, in relation to standards and training for child day care PURPOSE OR GENERAL IDEA OF BILL:: To ensure that child care providers receive training in Adverse Child- hood Experiences (ACES), focused on understanding trauma and nurturing resiliency. SUMMARY OF PROVISIONS:: Section 1 of this bill adds a new subparagraph (x) to paragraph (b) of subdivision 3 of section 39o-a of the social services law to add train- ing in adverse childhood experiences (ACEs), focused on understanding trauma and nurturing resiliency, to the list of training topics current- ly required for operators, program directors, employees and assistants of family day care homes, group family day care homes, school-age child care programs and child day care centers.

BIAGGI -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families AN ACT to amend the social services law, in relation to standards and training for child day care THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraphs (viii) and (ix) of paragraph (b) of subdivi- sion 3 of section 390-a of the social services law, subparagraph (viii) as amended by chapter 552 of the laws of 2003 and subparagraph (ix) as amended by chapter 117 of the laws of 2010, are amended and a new subparagraph (x) is added to read as follows: (viii) statutes and regulations pertaining to child abuse and maltreatment; [and] (ix) for operators, program directors, employees and assistants of family day care homes, group family day care homes and child day care centers, education and information on the identification, diagnosis and prevention of shaken baby syndrome[.]; AND (X) ADVERSE CHILDHOOD EXPERIENCES (ACES), FOCUSED ON UNDERSTANDING TRAUMA AND ON NURTURING RESILIENCY. § 2. Subdivision 3 of section 390-a of the social services law is amended by adding a new paragraph (f) to read as follows: (F) THE OFFICE OF CHILDREN AND FAMILY SERVICES SHALL ISSUE REGULATIONS ESTABLISHING THAT TRAINING WITH RESPECT TO ADVERSE CHILDHOOD EXPERIENCES SHALL BE INCLUDED WITHIN THE MINIMUM HEALTH AND SAFETY TRAINING REQUIRE- MENTS FOR CHILD DAY CARE PROVIDERS, INCLUDING THOSE THAT ARE OTHERWISE LEGALLY EXEMPT FROM THE PROVISIONS OF SECTION THREE HUNDRED NINETY OF THIS ARTICLE, OTHER THAN THE PARENT, STEP-PARENT, GUARDIAN, OR RELATIVE WITHIN THE THIRD DEGREE OF CONSANGUINITY OF THE PARENTS OR STEP-PARENTS OF SUCH CHILD WHO PROVIDES CARE ONLY FOR A CHILD OR CHILDREN RELATED TO THEM. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed by the commissioner of the office of children and family services on or before such date.
