BILL NUMBER: S5338 SPONSOR: COMRIE TITLE OF BILL: An act to amend the public authorities law and the economic development law, in relation to requiring public corporations and agencies to provide notice to each minority- or women-owned business enterprise that unsuccessfully bid on a contract of the reason or reasons why the business enterprise was unsuccessful in obtaining the contract PURPOSE: This bill would inform minority and women-owned businesses of the reason that they were not awarded a State or municipal MBE contract SUMMARY OF PROVISIONS: Section 1 requires corporations provide notice to each minority or women-owned business enterprise that unsuccessfully bid on contract(s) within 30 days of awarding a contract

COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law and the economic development law, in relation to requiring public corporations and agencies to provide notice to each minority- or women-owned business enterprise that unsuccessfully bid on a contract of the reason or reasons why the business enterprise was unsuccessful in obtaining the contract THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause IV of subparagraph (H) of paragraph (j) of subdivi- sion 3 of section 2879 of the public authorities law, as added by chap- ter 174 of the laws of 2010, is amended and a new subparagraph (I) is added to read as follows: IV. consult the most recent disparity study pursuant to article fifteen-A of the executive law[.]; AND (I) A REQUIREMENT THAT, WITHIN THIRTY DAYS OF THE AWARDING OF A CONTRACT, THE CORPORATION AWARDING THE CONTRACT PROVIDE NOTICE TO EACH MINORITY- OR WOMEN-OWNED BUSINESS ENTERPRISE THAT UNSUCCESSFULLY BID ON THE CONTRACT OF THE REASON OR REASONS WHY THE BUSINESS ENTERPRISE WAS UNSUCCESSFUL IN OBTAINING THE CONTRACT. § 2. Section 143 of the economic development law is amended by adding a new subdivision 5 to read as follows: 5. WITHIN THIRTY DAYS OF THE AWARDING OF A CONTRACT, THE AGENCY AWARD- ING THE CONTRACT SHALL PROVIDE NOTICE TO EACH MINORITY- OR WOMEN-OWNED BUSINESS ENTERPRISE THAT UNSUCCESSFULLY BID ON THE CONTRACT OF THE REASON OR REASONS WHY THE BUSINESS ENTERPRISE WAS UNSUCCESSFUL IN OBTAINING THE CONTRACT. § 3.
