BILL NUMBER: S5462 SPONSOR: MAY TITLE OF BILL: An act to amend the election law, in relation to declining party nominations after primary elections PURPOSE OR GENERAL IDEA OF BILL: This bill will allow candidates for office to decline a nomination on one or more party lines in the event that they lose a primary election for another line. SUMMARY OF SPECIFIC PROVISIONS: Section 1: adds a new subdivision 15 to Section 6-158 of the election law to allow a nominee for public office to decline any nomination or nominations for such office after losing a primary up to 15 days after said primary loss. Section 2: effective date.

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to declining party nomi- nations after primary elections THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 6-158 of the election law is amended by adding a new subdivision 15 to read as follows: 15. A PERSON WHO HAS BEEN DESIGNATED FOR NOMINATION FOR PUBLIC OFFICE BY ANY PARTY OR PARTIES AND WHO THEREAFTER DOES NOT RECEIVE ONE OR MORE SUCH NOMINATIONS MAY DECLINE ANY NOMINATION OR NOMINATIONS FOR SUCH OFFICE NOT LATER THAN THE FIFTEENTH DAY AFTER THE PRIMARY ELECTION. § 2.
