BILL NUMBER: S6156 SPONSOR: STEWART-COUSINS TITLE OF BILL: An act to amend the private housing finance law, in relation to the statewide or regional multi-state contract adminis- tration and support services for federal section eight project based housing assistance payments contracts PURPOSE OF THE BILL: The purpose of this bill is to clarify and reinforce a New York State, long- standing position that the Housing Trust Fund Corporation ("Corpo- ration") and the Division of Housing and Community Renewal ("DHCR") are the public housing agencies authorized to undertake statewide contract administration for Section 8 project based housing assistance adminis- trative contracts pursuant to New York state law and the United States Housing Act of 1937 ("the Act"). This legislation is necessary to preserve state and local control over project based administration. Without a clear articulation of authority for a state agency to adminis- ter these project based contracts, it is possible for private industry to take control of the federally assisted housing stock in New York.

STEWART-COUSINS -- (at request of the Division of Housing & Community Renewal) -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the private housing finance law, in relation to the statewide or regional multi-state contract administration and support services for federal section eight project based housing assistance payments contracts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "State and Local Project Based Housing Assistance Payment Contract Administration Act of 2019". § 2. Subdivisions 10, 11, and 12 of section 45-a of the private hous- ing finance law, subdivision 11 as renumbered by chapter 261 if the laws of 1988, are renumbered subdivisions 11, 12, and 13 and a new subdivi- sion 10 is added to read as follows: 10. THE CORPORATION IS A PUBLIC HOUSING AGENCY AS DEFINED IN THE UNITED STATES HOUSING ACT OF 1937, AS AMENDED AND MAY RECEIVE AND ADMIN- ISTER FUNDS INCLUDING BUT NOT LIMITED TO SUBSIDIES, LOANS AND FEES MADE AVAILABLE THROUGH FEDERAL PROGRAMS UNDER SUCH ACT. (A) THE CORPORATION SHALL BE THE SOLE ENTITY WITH AUTHORITY IN THE STATE TO UNDERTAKE ANY STATEWIDE OR REGIONAL MULTI-STATE CONTRACT FOR PERFORMANCE BASED ANNUAL CONTRIBUTIONS CONTRACT ADMINISTRATION ISSUED UNDER AUTHORITY GRANTED IN SECTION EIGHT OF THE UNITED STATES HOUSING ACT OF 1937, AS AMENDED, OR ANY REPLACEMENT PROGRAM OR CONTRACT, WHETHER CALLED AN ANNUAL CONTRIBUTIONS CONTRACT OR OTHER NAME, THAT REQUIRES SUBSTANTIALLY THE SAME ADMINISTRATION OR SUPPORT SERVICES OFFERED NATIONALLY, REGIONALLY OR STATEWIDE. THE CORPORATION MAY IN ITS DISCRETION SUBCONTRACT SUCH ACTIVITIES AS IT MAY REQUIRE. THE DIVISION OF HOUSING AND COMMUNITY RENEWAL SHALL BE THE ENTITY RESPONSIBLE FOR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
