BILL NUMBER: S6346 SPONSOR: SEPULVEDA TITLE OF BILL: CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 15 of article VI of the constitution relating to the New York city civil court PURPOSE: The purpose of this bill is to increase the jurisdiction of New York City Civil Court for actions and proceedings in the recovery of money or property worth no more than twenty-five thousand dollars to no more than fifty thousand dollars. SUMMARY OF PROVISIONS: Section 1 amends subdivision b of section 15 of Article IV of the Constitution to read that the court of city-wide civil jurisdiction of the city of New York shall have jurisdiction over actions and proceedings for the recovery of money, recovery of chattels and the foreclosure of mechanics liens and liens on personal property where the

SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 15 of article VI of the constitution relating to the New York city civil court Section 1. Resolved (if the Assembly concur), That subdivision b of section 15 of article VI of the constitution be amended to read as follows: b. The court of city-wide civil jurisdiction of the city of New York shall have jurisdiction over the following classes of actions and proceedings which shall be originated in such court in the manner provided by law: actions and proceedings for the recovery of money, actions and proceedings for the recovery of chattels and actions and proceedings for the foreclosure of mechanics liens and liens on personal property where the amount sought to be recovered or the value of the property does not exceed [twenty-five] FIFTY thousand dollars exclusive of interest and costs, or such smaller amount as may be fixed by law; over summary proceedings to recover possession of real property and to remove tenants therefrom and over such other actions and proceedings, not within the exclusive jurisdiction of the supreme court, as may be provided by law. The court of city-wide civil jurisdiction shall further exercise such equity jurisdiction as may be provided by law and its jurisdiction to enter judgment upon a counterclaim for the recovery of money only shall be unlimited. § 2. Resolved (if the Assembly concur), That the foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly, and, in conformity with section 1 of article 19 of the constitution, be published for 3 months previous to the time of such election.
